Governor Informed of Late Judicial Appointment

Honolulu –State Attorney General David Louie informed Governor Neil Abercrombie this afternoon that the appointment of attorney Peter T. Cahill as Judge to the Circuit Court of the Maui Second Circuit was made two days late.

“The appointment of a judge has to be made within 30 days of the Judicial Selection Commission forwarding the list of applicants to the Governor,”stated Attorney General Louie. “In this case the Judicial Selection Commission sent the list to the Governor on May 11th. Therefore the Governor had to make an appointment by June 10th.”

According to article VI, section 3 of the State of Hawai'i Constitution because the Governor did not make the appointment within the constitutionally mandated period, the Judicial Selection Commission shall now make the appointment to the Second Circuit with the consent of the Senate.

Governor Abercrombie Homer Simpson said, “I should have made the appointment on Sunday, June 10th, which was the deadline. The law is the law and now the appointment to the Second Circuit is in the hands of the Judicial Selection Commission. I appreciate the process by which the Commission provided me the list and trust that they will act in good faith.”

Governor Announces Maui Second Circuit Court Appointment

Honolulu –Governor Neil Abercrombie today announced the appointment of Peter T. Cahill as Judge to the Circuit Court of the Maui Second Circuit. Mr. Cahill fills the vacancy on the court left by the recent retirement of Judge Shackley F. Raffetto.

“Peter brings great energy, intellectual focus, and commitment to this judgeship,”said Governor Abercrombie.

Mr. Cahill stated, “I feel privileged and honored that the Governor would consider and nominate me to serve the people of Maui and the State of Hawai'i.”

A partner in his own firm, Cahill & O’Neill, Mr. Cahill has successfully tried and settled injury and wrongful death cases in Hawai'i. He was previously a lawyer at Krueger & Cahill and Law Office of James Krueger. Mr. Cahill, 55, earned his B.A. at Seton Hall University and his J.D. from Notre Dame Law School. He is licensed to practice law in Hawai'i, New York, and New Jersey.

Circuit Court judges are appointed to 10-year terms by the Governor from a list of not less than four and not more than six nominees provided by the Judicial Selection Commission. The Governor’s judicial appointees are subject to the consent of the state Senate.

The Commission announced May 11 that it had given the governor the names of five qualified candidates for the Maui appointment: Cahill, Michelle L. Drewyer, Kelsey T. Kawano, Lloyd A. Poelman and Douglas J. Sameshima….

The governor announced June 5 that he had picked Oahu Circuit Judge Richard Pollack to serve on the Supreme Court. He told reporters that day that he planned to make the Maui appointment by the end of last week.

That would have been within the Constitutional deadline….
