Hawaii Among Top 10 U.S. States With Highest Medical Malpractice Claim Rates
A new study reveals Hawaii has the fifth highest medical malpractice claim rate in the United States.
from Anidjar & Levine, May, 2025
A new study by Florida-based personal injury lawyers Anidjar & Levine analyzed medical malpractice payment report data between 2020 and 2024 from the National Practitioner Data Bank (NPDB). By comparing the number of practitioners to respective malpractice claims, the research identified states that present the highest risk for medical malpractice incidents.
Hawaii ranks fifth, with 87 medical malpractice payment reports per 1,000 practitioners — 71% higher than the national average of 51. Home to 2,221 practitioners, the state saw 193 medical malpractice payment reports between 2020 and 2024.
Looking at the study, a spokesperson from The Law Offices of Anidjar & Levine commented,
"According to the study, Hawaii reported the fifth highest medical malpractice claim rates in the United States.
“Medical malpractice claims in the United States don't just represent medical errors, they indicate systemic problems that harm patients, burden healthcare systems, and strain medical resources. Affected patients and families face overwhelming grief along with medical bills and financial instability. These incidents create a chain reaction of hardships that extend far beyond the initial incident.
"To reduce these incidents, states need stronger oversight of medical practices, improved training programs, better reporting systems, and stronger patient safety initiatives. High-risk states, especially those with consistently elevated claim rates, require immediate intervention before more patients are harmed."
