Foster Care Rape Room: Police Report Blows Away CWS Coverup

For the five years, in response to a 2019 lawsuit filed on behalf of alleged juvenile foster care victim ‘TG’, lawyers representing Hawaii Department of Human Services kept claiming that DHS knew nothing of sexual abuse allegations in the Kailua Kona foster care home run by Gloria Holmes. 

But now, according to a source, defendants have agreed to settle.  The State of Hawaii will pay ‘TG’ $600,000, Catholic Charities $90,000, and Gloria Holmes’s state-provided insurer will pay $38,000.  The settlement is expected to be entered into court records—under seal--next week.  (Case: Graves v Hawaii 3CCV-19-0000022)

What changed their tune?

A 2015 Hawaii County Police report, uncovered during discovery by plaintiffs’ attorneys, blew CWS denials out of the water.

It reads:

Public Summary for Incident M15078231

On 12-19-2015/1000, I was assigned by Lt G Gaspar to a cyber tip line report 7709685) from the National Center for Missing and Exploited Children (NCMEC). 

The report indicated (REDACTED) F-60 reported concerns for unidentified children that Gloria Holmes, foster parent, currently cares for at her residence in Kailua-Kona, Hawaii. (REDACTED) reported she believes that children in the home were being sexually exploited, possibly in exchange for prescription drugs.

(REDACTED) reportedly observed the changing of one of the children’s diapers and saw something ‘dark’ between the child’s legs, and thought that this was an injury possibly due to exploitation.  (REDACTED) believes that social services are protecting Holmes.  (REDACTED) further reported unidentified adult men in the home view movies containing nudity, possibly when the children are present. She believes there is drug use and drugs being sold there, lots of traffic with adult males and nudity observed on the television with the children present.   She observed what appeared to be redness or irritation to a 5 year old female’s vaginal area and overheard Gloria call a female child a ‘little fat bitch.’  She also reported a six year old looks like she is three.  She observed a man picking up a young male child by his pants.  Adult men were watching when the children’s diapers are being changed and the children are never taken out of the house.

The Hawaii County PD kept this report in its files and provided it to plaintiffs’ attorneys in response to a subpoena.  This stands in sharp contrast to DHS pretending to ‘know nothing’ of any complaints regarding Holmes.

Unfortunately, in spite of ‘social services’ being identified as an accessory to child molestation by the complaining witness, Hawaii County PD handed the complaint over to that alleged accessory. 

Here is the result:

12-3-2015/1315  I contacted Child Welfare Services (CWS) and spoke to Wendy Robinson.  I informed her of the above information.  She related that CWS received a call of concern on or about December 11, 2015 and checks were conducted at Gloria Holmes residence.  No allegations were confirmed and CWS related there are no current concerns.  Police assistance is not necessary CWS did not generate an intake regarding the above information.

‘TG’ was placed in foster care with Gloria Holmes a year-and-a-half later, on or about July 31, 2017, then allegedly endured several months of sexual assault at the hands of two different adult male alleged perpetrators who were living in the house.

Both have criminal records.  One is a diagnosed schizophrenic. 

The complaint alleges:

23. Prior to Plaintiff’s placement with Defendant G. Holmes, Plaintiff met with her assigned Child Welfare Services case worker, Defendant (Kerry) Perez, at Starbucks in Waimea, Hawai‘i.

24. Plaintiff’s older sister was also present at this meeting.

25. During this meeting, Plaintiff’s sister disclosed that, while she was a minor, she was sexually abused by Defendant Puaoi-Marcellino.

26. Defendant Puaoi-Marcellino is a family friend and frequent visitor to the home of Defendant G. Holmes, and has been known to stay at the residence.

27. Kerry Perez overheard this disclosure and responded, “Don’t tell her [Plaintiff] that otherwise she won’t go there [G. Holmes’ residence].”

28. Shortly thereafter, Plaintiff was placed in the foster home of Defendant G. Holmes, who was approved by Defendant DHS to be a foster parent.

29. Defendant Puaoi-Marcellino would often visit the home of Defendant G. Holmes unannounced and had open access to the home.

30. Defendant Puaoi-Marcellino lived at the residence of Defendant G. Holmes from approximately October 2017 to February 2018.

31. Within two months of Plaintiff’s foster placement with Defendant G. Holmes, Defendant Puaoi-Marcellino showed a sexual interest in Plaintiff, who, at the time, was thirteen (13) years old….

The suit then graphically details multiple allegations of sexual assault on the 13 year old victim in 2017 and 2018.  And, “after being repeatedly sexually assaulted, Plaintiff suffered from suicidal ideations and depression.”

The Attorney General’s office tried and failed to block the suit from being reinstated complaining, “Defendant Kerry Perez, a former employee of the Department of Human Services, has left the employ of the Department and has relocated to the Mainland.”

In January, 2020, three months after the original suit was filed, defendant Tye Puaoi-Marcellino was charged with felony family abuse in a separate Hawaii Family Court case.  On March 4, 2020, he was sentenced to 48 hours confinement and two years probation.
