Miske Hitman Criminal Record Secretly Expunged

Half of all Expungements Went to Miske Gang

Legislators have sent SB2706 and HB1595 to the Governor’s desk.  These bills would give tens of thousands of Hawaii criminals a fresh start on their chosen career by ‘expunging’ their criminal records.

SB2706, “Establishes the Clean Slate Expungement Task Force to develop a state-initiated record clearing program.”

HB1595, “Creates a pilot project, to be administered by the Department of the Attorney General, for a state-initiated expungement process of arrest records concerning certain marijuana offenses under section 712-1249, HRS.” 

How will this work?

Ask Lindsey Kinney.

Of the 12,000 criminals eligible for expungement under the State’s current ‘record clearing program’ only two have ‘expunged’ their criminal records over the last four years in Hawaii according to the Hawaiʻi Criminal Justice Data Center as cited by Hawaii Public Radio

At least 50% of them worked for Michael Miske.

Perhaps you remember alleged Miske hitman, sovereignty activist, and Q-Anon believer Lindsey Kinney? He’s cooling his heels in Lompoc FCC after threatening to behead the Waianae harbormaster

Expungement under current state law is a secret judicial proceeding conducted in contravention to the common law principles of an open court system.  We asked the Attorney General’s office about Kinney’s expungement.  We also asked: ‘If a criminal is using a forged expungement certificate, is the AG unable to confirm that the certificate is fraudulent?’ 

This is what they told us:

“The Department of the Attorney General is not allowed to disclose or confirm expungement information or whether a certificate is authentic.  Expungement information is confidential and may only be released to statutorily authorized agencies for specific purposes.

“1) A court of law or an agency thereof which is preparing a presentence investigation for the court.

“2) An agency of the federal or state government which is considering the subject person for a position immediately and directly affecting the national or state security; or

“3) A law enforcement agency acting within the scope of their duties.”

You won’t find any record of expungement proceedings on ECourtKokua—they’re secret.  The only reason we know about Lindsey Kinney’s expungement order is because he posted it on his Instagram Page.  If you look closely, you can see it is signed August 8, 2019, by the administrator of the Hawaiʻi Criminal Justice Data Center.  The Attorney General at the time was Clare Connors.

According to the expungement order, Kinney was arrested eleven times between 2002 and 2016.  E Court Kokua doesn’t list arrests--only court proceedings.  Are the County Police to be ordered to wipe their databases of arrest records?   What risk will attach to officers when unknowingly confronting a multiple offender?  Will honest citizens be at risk due to defensive police procedures designed to treat everyone as a hardened criminal?

The missing data includes:

  • Three 2011 TROs stemming from Kinney’s involvement in a Kaneohe brawl which led to the shooting death of former Castle High School star quarterback Joel Botelho.
  • Eight Domestic Abuse Cases/TROs in the period 2014-2016.

It is clear the “Clean Slate Expungement Task Force” intends to erase from E Court Kokua the records of cases where a conviction was obtained.  It seems then a lesser step to further violate the principle of an open court system by erasing court records of cases not leading to conviction, thus validating witness intimidation against domestic violence victims.

Task Force is stacked with members including OHA, the Public Defender’s Office, and the following criminal-friendly activist groups:

  • The Hawaiʻi Innocence Project
  • The Hawaii Workers Center
  • The ACLU of Hawaiʻi
  • The Hawaiʻi Friends of Restorative Justice
  • The Last Prisoner Project

How Kinney Got His Guns 

Identical text from both SB2706 and HB1595 reads: “The legislature recognizes that arrest and conviction records often adversely affect a person's financial and housing security by limiting the person's access to employment, housing, or a professional license.” 

Let’s see how this works:

EMPLOYMENT? 

Kinney had gainful tax-free employment as an alleged ‘hit man’ and ‘enforcer’ for the Napiki Motorcycle gang and, of course, the de-rigueur gig as a card-carrying member of IATSE, the mafia union representing TV and motion picture workers. 

HOUSING? 

Kinney allegedly squatted on a piece of land stolen from an elderly HPU professor.  His Instagram videos show him rising each morning to smoke weed, spout conspiracy theories, and tend to the roosters and dogs, which implies yet another source of tax-free income. 

 

PROFESSIONAL LICENSES?

This is where it gets interesting.

Apparently, Kinney had housing and employment in hand but needed a ‘fresh start’ to get ‘a professional license’ and his expungement, dated August 8, 2019, gave him exactly that. 

SB2706 burbles: “The legislature notes that by being more easily available to attain employment and housing, individuals with cleared records are significantly less likely to reoffend, contributing to safer communities and reducing recidivism rates.”

Kinney claims he turned down Michael Miske’s 2016 contract to murder Jonathan Frasier for $50,000.  He also claims he passed up a $20,000 offer to buy his silence.

Kinney claims he was shot at by Miske and his thugs in 2017 on a Kualoa Ranch movie set.

July 7, 2020, less than eleven months after his expungement, Kinney described all of these events in an interview with HNN

Documents Kinney posted on his Instagram page show he had completed a mandatory gun safety course September 10, 2018.  Passing the course is one thing, but a convicted felon (auto theft, 2003 #1PC031001817) has no legal right to own a gun in Hawaii.

Did Hawaii’s political leaders finally find, in Lindsey Kinney, the one and only kind of person whose gun rights they want to uphold?

 

If so, it didn’t last long.

According to Court records, which may soon be wiped off the books by the ‘Clean Slate Expungement Task Force,’ Kinney’s guns were seized as a condition of his February 22, 2021, release on recognizance while awaiting trial on the kind of stuff the state judiciary handles -- a COVID ticket.  (Case# 1CPC-21-0000147.)  Without these records of manini prosecutions for major criminals, the public will never understand why the Miske gang slogan is ‘Defend Hawaii.’

In early 2022, Kinney, while awaiting his turn as a Miske trial witness, threatened to behead the Waianae Harbormaster.  

No COVID ticket this time.  With the feds involved, suddenly everything was different.

On April 7, 2022, Kinney’s sealed indictment was handed down.

On April 13, 2022, Kinney was arrested by FBI. 

Maybe Governor Green could fly him in for the signing ceremonies.
