Update on status of Deputy Prosecutor Jan Futa

Dear supporters and signatories of the Petition to Impeach Honolulu City Prosecutor Kaneshiro,
On February 12, 2019, more than 60 days after the initial media reports that Deputy Prosecutor Jan Futa had received a Department of Justice “Subject Letter”, Prosecutor Kaneshiro’s attorney William McCorriston made a public announcement stating that Deputy Prosecutor Jan Futa did not receive a Department of Justice Target Letter. This announcement is the first time that ANYONE has made a statement denying Ms. Futa’s receipt of this letter.
Following this announcement by Mr. McCorriston; in statements made to various media sources, Mr. McCorriston has knowingly made false allegations that I committed perjury by stating in this Petition, that Deputy Prosecutor Jan Futa had received a "Subject Letter", and that I "possibly" mislead people into signing and supporting this Petition. Based on the information known to me at the time that this Petition was started, up until February 12, 2019 (more than 60 days), along with Prosecutor Kaneshiro's refusal to admit or deny the reports concerning the Department Justice Letters that he (Prosecutor Kaneshiro), Deputy Prosecutor Jan Futa, and Deputy Chasid Sapolu had “reportedly” received, I allege that Mr. McCorriston has knowingly and falsely accused me of committing the act of perjury, The criminal offense of perjury consists of making a false statement under oath, either in writing or verbally, that one knows is false. To prove perjury, you must show that someone intentionally lied under oath. The essential legal element of "Actual Notice" is also absent in this situation as well Mr. McCorriston's allegation of perjury. An attorney with Mr. McCorriston’s legal education and experience, should certainly realize his allegation is both false and "baseless".
As far as Mr. McCorriston’s claims that we failed to “properly serve” Prosecutor Kaneshiro with the Petition to impeach him, that is nothing other a tactic to stall the process, and delay the inevitable. Staff members at the Prosecutor’s Office routinely accept service of legal documents on behalf of the various attorneys in that office.
I humbly ask all concerned, that we stand strong, and not let anyone or anything stand in the way of our rights to pursue this impeachment action.
