2012: Insurance Broker Michael Van Gilder Indicted for Alleged Insider Trading
WSJ Oct 26, 2012: ..Michael Van Gilder, who recently stepped down as chief executive of Van Gilder Insurance Corp., has been indicted on five counts of insider trading, the Department of Justice said.
Mr. Van Gilder, who was a friend of an executive at Delta Petroleum Corp, now called Par Petroleum Corp., arranged for and provided insurance policies covering certain Delta businesses, according to the Justice Department.
From Nov. 5, 2007, and continuing until at least Jan. 9, 2008, Mr. Van Gilder allegedly committed securities fraud by trading in securities based on material, nonpublic information, the Justice Department said.
According to the indictment, on Nov. 8, 2007, ahead of the Denver company’s third-quarter earnings report, Mr. Van Gilder phoned his contact at the oil company and found out that the financial results weren’t going to miss expectations. The indictment states that based on that nonpublic information, Mr. Van Gilder instructed his stockbroker to buy more Delta shares and that he also emailed two friends to tell them they should buy the stock because Delta “will hit their numbers.”
The indictment charges Mr. Van Gilder with five counts of securities fraud. If convicted on all counts, he could be sentenced to as many as 100 years in federal prison, and pay as much as $25 million in fines....
