CB: … According to Seitz and Pelletier, Maui County Council Chair Alice Lee asked Maui police to investigate allegations raised by Bissen’s former chief of staff, Leo Caires, regarding potential fraud and financial mismanagement in the mayor’s administration. Caires, who was fired by Bissen after raising concerns, has filed a lawsuit against the county.

The police department began an investigation in July but soon found out another agency was already conducting a criminal investigation. Pelletier declined to say which agency, but Lee told Civil Beat on Friday it was the Hawaiʻi Attorney General’s Office.

“We are not the lead agency at this point,” Pelletier said, adding that the allegations involve “corruption, fraud and retaliation.”

Toni Schwartz, a spokesperson for the AG’s office, said in an email late Friday: “The Department of the Attorney General will not make statements on the existence or status of investigations or about possible pending cases.”

Pelletier said the police department does have a second investigation into the mayor that involves a possible felony. He refused to elaborate despite repeated questions from reporters. The chief said he has recused himself from any investigation being done by MPD.

Bissen says he is unaware of any criminal investigations, (which isn’t surprising since he didn’t notice Lahaina burning either….)

KHON: Pelletier was returning from an FBI conference in New Jersey when he learned he had been placed on leave. He said he was not given notice that the commission would consider the action.  “I believe this is a direct result of criminal investigations involving the mayor and his office that began in July of this year,” Pelletier said.

A typical Maui residential customer using 500 kilowatt-hours of electricity per month is expected to pay an additional $4.49 a month for 20 years under the proposal for Hawaiian Electric to buy electricity from AES generated by Pulehu Solar at a fixed price, according to the application….

Service members file appeal in Red Hill case

SA: … U.S. service members affected by the Red Hill water crisis but denied damages filed an appeal Friday, alleging the lower-court judge erred when she begrudgingly ruled in favor of the federal government.

U.S. District Court Judge Leslie Kobayashi called her dismissal of the case Opens in a new tab in July “an overly harsh and unjust outcome,” but held that prior case law and the application of a legal test known as the “Feres doctrine” prevented her from ruling in favor of the service members.

The doctrine applies a four-prong test to determine whether an injury incurred by military members was “incident to service.” Those tests include the location of injuries, the service member’s duty status, the benefits accrued because of military status, and the nature of the activities when injured….
