SA: … State Sen. Kurt Fevella — who lost a random draw to break a 1,212-to-1,212-vote tie in his Aug. 8 Republican Party primary race — on Wednesday asked the Hawaii Supreme Court to invalidate the results of his reelection defeat to former state Rep. Bob McDermott to represent Ewa Beach-Ocean Pointe-Iroquois Point.

Fevella cited the Supreme Court’s ruling Friday that will require the state to hold a new election following a similar Republican primary tie between Rep. Kanani Souza (R, Kapolei- Makakilo) and Sheila Medeiros that ended with each receiving 842 votes.

No Democrat is running for the House District 43 seat so the winner between Souza and Medeiros wins automatically.

The winner of the Republican Senate District 20 race faces former University of Hawaii and San Francisco Giants minor league baseball player Markus Owens in the Nov. 3 general election.

In his Supreme Court filing, Fevella said, “This is an emergency because ballots will be heading to print on or about” Friday….

CB: … The Kauaʻi County Council is pumping the brakes on Bill 2998 after receiving the new estimates last week. The legislation would impose new construction standards to lessen the chance of wildfire embers igniting homes and spreading within a community.

For a 1,000-square-foot home, the bill was originally expected to add an extra $6,750 to the cost of building, but new estimates from the Contractors Association of Kaua‘i show the extra costs could be as high as $106,850….

License plate-reading cameras used on Maui — but not for surveillance, police say

HPR: … The Maui Police Department said it uses about three dozen controversial automatic license plate reading cameras to help with law enforcement, but doesn't use them for surveillance purposes.

MPD discussed its use of ALPR cameras this week during hearings at the Maui County Council, which is considering legislation to restrict how data from those cameras are used.

The hours of discussion at the council hearings come as companies like Flock Safety have come under fire because the data they collect can be used to track the movements of individuals — even those who haven’t committed any crimes. There's also been reporting of law enforcement already abusing that information.

MPD said it currently uses 32 cameras, with others broken, stolen, or vandalized. The open-source DeFlock Maps shows about 40 cameras on Maui, representing about half of the total in the state. It says around two-thirds are Flock cameras, and the rest are from Motorola Solutions… The police department said its cameras are from Motorola….

Visitors asked to stay away from Kauai during Hurricane Lowell recovery

HNN: … in the immediate aftermath of Hurricane Lowell, the message to tourists is clear: now is not the time to visit.

“If you’re very insistent on visiting Kauai, just be clear that you’re not going to see the Kauai that you imagined or you thought you would see because of what happened with Hurricane Lowell,” said retired tourism executive Mufi Hannemann.

Hannemann said the priority on Kauai is helping residents recover from Lowell’s damaging winds and storm surge.

“The greatest needs on Kauai are food, electricity and gas. And unless you are going there to provide that kind of relief or assistance, or you’re visiting family, this is not the time to visit,” he said….
