Withdrawn Opinion Could be Exploited by Corrupt Officials
SA: … Silvert said that McKenna’s opinion could have opened the door for the three defendants to go back to federal court and ask to withdraw their guilty pleas, and say they are actually innocent because it is not a state crime, and ask for a reconsideration “because now there is a state opinion.”
But McKenna, joined by Eddins, quickly withdrew the opinion. She wrote in the Oct. 3 withdrawal, “I apologize for misinterpreting the factual basis for the criminal offense underlying this disciplinary proceeding.”
Silvert said it is “almost unheard of to withdraw a concurring opinion.”
“I’ve seen opinions withdrawn before, but it’s very rare. It’s usually when a party has asked for reconsideration.”
But in this case, no one made a motion for reconsideration. “It was on their own accord,” Silvert said….
He said the withdrawal prevents the defendants from going back to federal court because there is nothing to support that.
Still, Silvert said, McKenna’s withdrawal of her opinion could have a long-term effect.
“In the future, if someone within the city government tries to do the same thing in terms of how they structured the deal, we’ve got two Supreme Court judges that say doing this is not a crime,” Silvert said. “So even though they’ve withdrawn their opinion, it kind of suggests it wouldn’t be in violation of state law.” …

Pa’ia Elementary School remains closed through Oct. 14
KITV: … The elementary school will be closed on Monday and Tuesday, Oct. 13 to 14, with distance learning to continue. Environmental cleanup efforts after the brush fire on Sept. 23 have been completed, according to the Hawaii Department of Education (HIDOE).
HIDOE is working with the Hawaii Department of Health to conduct wipe testing on campus and ash testing off campus to detect possible heavy metals.
Pa’ia Elementary School has been closed since Sept. 24, initially due to a requested power outage then afterwards for cleaning efforts to rid of post-fire soot….
(And the bums are still not removed.)

MMA legend BJ Penn ordered to take mental health exam
HNN: … “In the case of penal responsibility, the examiner is there to determine whether or not the person or the individual had the cognitive capacity at the time of the alleged offense,” Gormley said.
The doctor could determine if Penn is fit to proceed. In that case, the criminal cases will continue.
If Penn is deemed not fit to proceed, he will be committed to the custody of the state and be placed in an appropriate facility for treatment.
If the examiner finds Penn is not penal responsible but fit to proceed, Penn could potentially use that as a defense if his case goes to trial. If it does, a judge or jury could either find Penn guilty, not guilty, or not guilty by reason of insanity….
He is due back in court on Jan. 9 to discuss the psychologist’s findings….

Honolulu ‘resilience officer’ quits after only one year
SA: … Mayor Rick Blangiardi announced Friday that the City & County of Honolulu is accepting applications from highly qualified individuals for the city’s chief resilience officer and executive director of the Office of Climate Change, Sustainability and Resiliency (CCSR).
That post is charged with advancing the city’s mission to build more resilient communities across Oahu.
Honolulu’s next chief resilience officer will succeed Ben Sullivan, who left the city this month to pursue other career opportunities, according to a city news release….
