19 months later: Maui Council gives initial approval to bill to rebuild Lahaina disaster-impacted properties as they were
MN: … Maui County Council members voted 9-0 Friday morning for first-reading passage of Bill 105, which would allow disaster-impacted property owners to rebuild their homes and other structures to their original condition, even if they were decades old and didn’t meet current building codes. The measure advances to second-and-final reading.
The Council action follows last month’s unanimous approval by the Disaster Recovery, International Affairs, and Planning Committee, chaired by West Maui Council Member Tamara Paltin. It paves the way for Lahaina and Upcountry property owners, including churches, to rebuild after losing their homes in the August 2023 wildfires.
“Bill 105 provides property owners an opportunity to rebuild in Lahaina, while preserving community character,” she said. “This will help a number of people who already have their applications in at the Planning Department that are waiting for this bill to pass second reading, and it will help homeowners that have not yet got together with their design professionals, because they don’t want to move forward until it’s for sure.”

State Had Earlier Reports Of Abuse In Kapolei Household Where Girl Starved
CB: … The family of a 3-year-old girl who died from starvation and dehydration in June had been investigated previously for maltreatment of another child, according to a report released Friday by the state Department of Human Services.
But the two reports of physical abuse and neglect, as well as medical neglect, were not confirmed by DHS.
Sarai Perez-Rivera’s family also had been “engaged in services” through a state diversion program before her death, according to the report.
Such programs can involve counseling and other services designed to prevent children from being removed from the home and placed into foster care. DHS did not respond to a question about the exact nature of the program Sarai’s family had been in.
The report released Friday is required under the federal Child Abuse Prevention and Treatment Act. It included four other maltreatment deaths in the fiscal year that ended June 30. Although it did not name Sarai, the report included only one 3-year-old girl….

Law change behind challenge to criminal case against police officers in near-fatal crash
HNN: … Nahulu, in an unmarked SUV, and other officers in patrol cars allegedly chased a white sedan through Oahu’s west side without lights or sirens.
Near Orange Street, the car crashed, flipping multiple times. All six people inside were thrown and critically injured.
Witnesses at the scene said Nahulu’s subsidized SUV clipped the vehicle before it went airborne. But technology and expert witnesses, including the prosecution’s own, said there was no evidence of a collision between Nahulu’s SUV and the sedan.
“The state has to prove that the officer driving his vehicle was involved, and that there was a collision,” said Victor Bakke, a former deputy prosecutor turned defense attorney.
Bakke said the definition of collision doesn’t match the facts in the case, and the appeals court could dismiss the felony charge for Nahulu….
