HNN: … The Hawaii Supreme Court has issued its opinion on evidence that could affect a wrongful conviction compensation claim.

The justices said recordings of interviews and other reports about Albert Lauro, Jr. will remain sealed while the Hawaii Police Department investigates his role in the 1991 Dana Ireland attack….

The Hawaii Innocence Project filed a subpoena for the evidence against Lauro that was collected so far….

The brothers can now proceed with their civil claim for the money, up to $50,000 for every year they served behind bars.

The Hawaii Attorney General would be served as part of the claim and if the AG agrees that they qualify, the men will be paid.

If the AG does not agree that they qualify, the case will go to trial. Then, the Schweitzers can file another subpoena for the evidence and records pertaining to Lauro to use in that trial.…

Some Hawaii Schools Ban Cell Phones In Class. Should More Follow?

CB: … After years of trying to keep students from using their phones during the school day, Kihei Charter School has invested roughly $9,000 in what administrators hope will be a foolproof way to keep mobile devices out of classrooms. 

The Maui school purchased 300 pouches this year that magnetically lock when students place their phones inside, said Head of School Michael Stubbs. High school students put their phones in the pouches at the start of the day and can only open them in the afternoon using a special unlocking station teachers store in their rooms.

So far the effort appears to be working. Teachers are reporting fewer distractions in class this year and more social interactions among students, Stubbs said. The school also purchased games like Connect 4 and Jenga for students to play during their free time.

“There’s less isolation,” he said ….

Honolulu mayor to veto controversial fireworks bill

KITV: … In a statement, the mayor said: "Given the Honolulu Fire Department's strong opposition, and with an eye toward increasingly drier weather conditions and ever-worsening wildfire concerns, I cannot in good conscience allow Bill 22 to become law."

HFD told the Honolulu City Council that there would be an inevitable increase in fires and medical emergencies if the fireworks ban is relaxed….

Council scrutinizes fire sprinkler tax credit measure

SA: … A measure allowing owners associations at existing high-rise residential buildings to apply for tax credits for installing automatic sprinkler systems is under Honolulu City Council review.

Introduced by Council member Andria Tupola, Bill 57, as drafted, would allow condominium HOAs on Oahu to file an application for a tax credit with the city Department of Budget and Fiscal Services ….

Work on Coco Palms project could be halted by mortgage broker seeking ‘owed’ $1 million commission for securing funding

KNN: … An upcoming court hearing about the ownership of a prime property on Kauaʻi could lead to another setback for the Utah-based developer who is building a controversial 350-unit hotel on the site that once housed the iconic Coco Palms Resort.

In June, a three-judge panel of the Hawaiʻi Intermediate Court of Appeals canceled the 2021 foreclosure sale of the property that had been abandoned for 30 years after it was destroyed by Hurricane Iniki in 1992. The case was sent back to the circuit court for further proceedings.

On Sept. 16, Honolulu-based attorney Keith Kiuchi — who is representing a mortgage broker who claims he’s owed $1 million by previous developer Coco Palms Hui  — filed a motion asking Fifth Circuit Court Judge Randal Valenciano to grant a preliminary injunction ordering current developer Reef Capital Partners to stop all work at the property.

It also asks for the judge to cancel the transfer of ownership from Coco Palms Hui to Utah investment firm Private Capital Group, an agent of Reef Capital Partners, and vacate the prior foreclosure judgment, per the appeals court’s June decision.
