To Tax or Not to Tax Sale of Food and Medicine

Tax Evasion News: Hunt sells Palamanui property to Nan at Deep Discount Price

HTH: … The land slated for a university village around Hawaii Community College-Palamanui has changed hands, but development of the massive project isn’t expected to change much under new ownership.

Owner Hunt Companies Inc. in April sold the property to SMC Kona LLC, a company affiliated with the state’s largest locally owned and operated general contractor Nan Inc. The sale price of $15 million is less than half the price the property last cost, when it sold for $33.3 million in 2007, according to county tax records….

(According to DCCA BREG, SMC Kona LLC is managed by convicted felon Nan Shul Chin personally, not by Nan, Inc.)

The 720-acre parcel adjacent to the community college is anticipated to include 1,116 residential units, a 30-acre university village town center with a 120-room hotel, retail shopping, commercial amenities, a 70-acre business park, a regional public park, 1,230 acres of open space and 74-acre dry forest reserve. Build-out is expected to take 20 years….

“Hunt recently went through a zoning condition amendment process with Hawaii County about two years ago. Hunt also had grandiose plans to build around the Palamanui college campus,” Stene said in his email to the Land Use Commission…..

(NOTE: The price should have gone up not down from 2007, especially with the entitlements Hunt obtained for the property.  By selling at such a discount, Hunt avoids State and Federal Capital Gains Taxes.  Perhaps there is a hidden transfer which is part of the actual sales price--but not taxed because it is not declared.  For instance, Nan may agree to reduce debt owed by Hunt for work on a Hunt project elsewhere.  If so, this would be tax evasion.)

Supreme Court Ruling Gets Firearms charges dismissed against Paia man

MN: … With the defense citing a recent U.S. Supreme Court decision confirming that the right to carry handguns for self-defense extends outside the home, a judge dismissed firearms charges Wednesday against a Paia man who said he had a gun for self-protection when he was arrested on a trespassing charge…

In seeking to have the firearms charges dismissed, Lowenthal said that until 2008, it was understood that the Second Amendment was related to state militia. He said a 2008 Supreme Court case struck down a law banning handguns in residences in the District of Columbia and “clarified and made it abundantly clear we’re dealing with an independent right designed for an individual to have a firearm for self-protection purposes.”….

False claims about royal land patents still have followers

ILind: … On Friday, one of those who was arrested for trespass after occupying a part of a privately-owned agricultural subdivision in Kunia reaffirmed his belief in the proposition that most Hawaii land belongs to the descendants of those who received the initial land commission awards and royal patents some 170 years ago. It’s a false or mistaken claim that has fueled this and other land seizures around the state….

In his August 19 Facebook post, Hicks publicly asserted: “Royal Patents trumps Tax Map keys and limited warranty deeds,” followed by a happy face emoji.

It doesn’t seem to matter that no court, from the Hawaiian Kingdom through the present, has upheld this claim….
