SA: …Campbell Estate heiress Abigail Kawananakoa today was blocked in her bid to regain control of her $215 million trust.

First Circuit Court Judge R. Mark Browning ruled that Kawananakoa is not mentally capable of changing or revoking her trust and also of firing and replacing its trustee.

He did, however, remove the current trustee, James Wright, and appointed First Hawaiian Bank, pending its approval, as Wright’s successor. The bank was already spelled out as Wright’s successor in the trust’s document. Wright offered to resign as trustee more than a year ago in favor of First Hawaiian….

In making his ruling, Browning disagreed with the conclusion of the special master he appointed to evaluate the circumstances surrounding the dispute and to determine whether Kawananakoa is competent to manage her trust.

Honolulu Attorney James Kawachika had recommended to Browning that Kawananakoa be declared mentally capable of changing or revoking her trust and also of removing and replacing the trustee.

In a report to the judge, Kawachika urged Browning to explore the possibility of reaching a settlement that would include the voluntary resignation of Wright as successor trustee and the appointment of a trio of co-trustees: Honolulu accountant Warren Duryea, Kawananakoa’s long-time bookkeeper Betty Lou Stroup and Kawananakoa’s ‘wife’, Veronica Gail Worth.

Judge rules to dismiss Former Unity House Scammers’ case against Dive Oahu and city

SA: First Circuit Judge Dean E. Ochiai ruled this morning to dismiss the last remaining motions in Star Beachboys court proceedings against the city and Dive Oahu, the city’s current operator of the Waikiki beachboy concessions.

After hearing testimony in the case, Ochiai directed the defendants’ attorneys to draft a motion to dismiss the case.

“The court finds that there have been no genuine issues of material fact raised that would enable this complaint to move forward. The court gave an opportunity to the plaintiffs to file a second amended complaint and that second amended complaint still is deficient in the court’s eyes,” Ochiai said….

The change, which was challenged in court, also was marked by several protests from supporters of Star Beachboys and Hawaiian Oceans, which had previously held the city contracts. According to court documents, Dive Oahu also was subjected to harassment by unknown suspects that poured kerosene over surfboards and even set fire to a Kailua home owned by Dive Oahu’s owner Brian Benson.

Rofrits said there also has been unfair competition.

“There has been a lot of opposition on the beach to include previous stand owners illegally operating which has hindered our operation. They are selling as much as we are and we are paying rent,” Rofrits said.

(Unity House scammer) Aaron Rutledge owner of Star Beachboys said his company has a commercial-use permit to operate in state waters and has been legally operating from a Kuhio storefront since losing it’s city concession contract….

Another Hi-Tech Tax Credit Success Story--Algae biofuel company to sell All Equipment, Lay off all Workers

SA: A company that set out 11 years ago to test whether it could make fuel oil from algae in Hawaii announced Friday that it is ceasing research work….

Cellana Inc. said it has agreed to sell its 6-acre research facility on Hawaii island to Cyanotech Corp., a local company that produces microalgae for nutritional products at an adjacent 90-acre facility on a state technology park campus in Kailua-Kona.  A sale price was not disclosed.  (Too small.)

As part of the move, Cellana, which is based in San Diego and Hawaii, will lay off all of its 15 employees….

IM: …California Governor Jerry Brown signed Senate Bill 100 on September 10, 2018. The legislation requires retail electricity suppliers within the state to secure 100 percent of their power from renewables or zero-emissions sources by 2045 and updates the state’s existing renewable portfolio standard (RPS).

The bill differs from the Hawai`i 2045 mandate in three ways. Hawai`i and California have different definitions of “renewable energy” and “100 percent.” In addition, California ties renewable energy to greenhouse gas emissions while Hawai`i does not…..

Soft on Crime Policy Leads to Lockdown at UH Hilo

HTH: A suspect is in police custody after allegedly threatening gun violence Monday morning at the University of Hawaii at Hilo….

Medeiros said Kealoha is a student at UH-Hilo and was allegedly overheard saying he was going to “shoot people.”

Asked if Kealoha had a firearm, Medeiros said Kealoha was carrying a backpack.

“We’re in the process of getting a search warrant for it,” Medeiros said.

Court records indicate Kealoha was convicted in 2009 of first-degree terroristic threatening, a Class C felony. He’s also been convicted of misdemeanor assault, domestic abuse, resisting arrest and disorderly conduct…. (UH Hilo, the alma mater of Malu Mota.)

At 10:38 a.m., UH-Hilo sent out an alert by text message and email stating: “UH-Hilo has received a report of someone threatening gun violence on campus. The Hawaii Police Department has been notified and is on-site. We advise that people on campus shelter in place.”

The nearby campuses of Waiakea High, Intermediate and Elementary schools went on lockdown at 10:45 a.m.

At 10:58 a.m., UH-Hilo sent out a message staging: “UH-Hilo and the Hawaii Police Department have identified the source of the possible threat. The situation is resolved. ALL CLEAR.”

The Waiakea Complex schools lifted their lockdown at 11 a.m….
