Vote-by-Mail Fraud: Nago Helps Cachola Again

CB: …Ultimately, Cachola edged out Ganaden by 51 votes, 920 to 869. Cachola had trailed Ganaden by 10 votes in earlier results but a “suspicious and irregular submission of last minute mail in drop off ballots swung the election in Cachola’s favor,” according to the lawsuit.

The suit — which seeks a recount, removal of Cachola’s name from the general election ballot and investigations by the FBI, Office of Elections and state Attorney General’s Office — claims that Cachola coerced and intimidated voters in his district to vote for him through mail-in ballots by targeting patients of his wife’s medical practice in Kalihi, home to many first-generation Filipino immigrants who rely on the clinic for medical treatment.

The complaint indicates that two of the plaintiffs submitted sealed declarations to the court alleging to have seen Cachola improperly handle the absentee ballot of another person or witnessed a person voting twice. Nago argues that without being able to review this evidence, he can’t respond to the allegations.

He also argues that the requested remedies go far beyond the jurisdiction of the court since in an elections challenge, the Hawaii Supreme Court is only authorized to decide which candidate was elected or nominated.

But in order to do that, argued plaintiffs’ attorney Aaron Wills in a response filed late Tuesday afternoon, the court needs a more complete record on which to base its conclusions. He asked the court to compel the Office of Elections to turn over records from the 2018 primary election so it has more information to reach a decision….

Cachola will file his response to the complaint by Wednesday, according to his attorney Michael Green.

Under Hawaii statute governing the time frame for an elections lawsuit, the defendants must respond within five days of being served and the court has four days after that to issue a ruling….

Kingdom Come: Keanu Sai Lawyer Tells Hawaii Councilmember not to Accept Word of Corporation Counsel

HTH: … Kamelamela wrote Ruggles a four-sentence letter last week, assuring her she won’t violate laws by participating in council business.

“In response to your inquiry, we opine that you will not incur any criminal liability under state, federal and international law. See Article VI, Constitution of the United States of America (international law cannot violate federal law),” Kamelamela said in the Aug. 22 letter.

(Flashback Aug 22, 2018: “Until Corporation Counsel is able to assure, under applicable laws, that Council member Ruggles is not incurring criminal liability under international humanitarian law and U.S. law, she says she will be refraining from participating in the proposing and enacting of legislation for the Hawai‘i County Council.” –Oooops!)

But (now) that’s not enough for Ruggles, who wants (to exploit this for Keanu Sai by dragging) more legal advice from Kamelamela before she makes a decision about her next step (how to use this to save her daddy from his latest round of drug charges.)

“She (was instructed to say that she) felt the response she received from Mr. Kamelamela was inadequate and is asking him for a proper legal opinion that meets the legal definition of assurance that she can continue to legislate (can be exploited in daddy’s trial)….

(Translation: Kamelamela isn’t giving her lawyers enough of a handle to re-litigate the overthrow of the Hawaiian Kingdom so they demand more even after Kamelamela gave her exactly what she demanded.)

“Well if you are not going to do the job you were elected to, that’s your choice but you shouldn’t be accepting a paycheck either,” said Frannie Pueo. “Step down let the new elected person for district 5 take over. Our district needs representation.”

Hilo Councilman Aaron Chung brought the issue up again Aug. 22, the day after Ruggles made her surprise announcement, asking if the county can withhold her paycheck until she comes back to represent her district by voting on the council.

“We have a fiduciary duty to the taxpayers of this county,” Chung said.

As Ruggles dropped out of her re-election race, any vacancy in office would last only until Dec. 3, when new council members are sworn in. Under the county charter, the remaining council members must appoint a successor within 60 days or the council chairman must appoint one. The appointment is for the remainder of the council term…..

Ruggles Attempting to ‘Set Up’ Sovereignty Litigation

BIVN: …In as much as Ms. Ruggles has retained the services of her private attorney – whose opinions are contrary to what you had told us verbally, yesterday – I would say don’t put anything in writing. Let her make the move.”

Chung told Kamelamela, “it would be a misuse of county funds for you to expend any resources trying to address that, because it could be used later in some kind of litigation. I don’t want to think poorly of Ms. Ruggles, but I think… it’s not out of the realm of possibilities that they’re trying to set up your office. I would say to stay out of it.”….

How Top Lawmakers Build Their Power With Campaign Cash

CB: …Top Hawaii House and Senate leaders have given out nearly $200,000 to other candidates since 2006….

their success rates vary wildly. Saiki, who has given almost $41,000 to at least 23 candidates, has only invested in a losing race once, according to state campaign finance data. But 16 of the 41 candidates Kouchi has given a combined $53,000 to since 2009 went on to lose their election. 

Luke dishes out more of her campaign money to other candidates than any of her colleagues do. She’s donated almost $100,000 to about 37 candidates since 2006, with more than a third of that money going out in the last two elections alone — a notable uptick that’s not unique to her.

Only two of those candidates lost: Randy Iwase in his 2006 bid for governor and Jason Bradshaw in his effort to beat then-Republican Kymberly Pine in a 2010 House race….

Hawaii law prohibits political candidates from using their own campaign funds to directly support the campaigns of other candidates.

But some state legislators and other officeholders have long gotten around the ban through a loophole that lets them buy up to two tickets to another politician’s fundraiser for an amount that can equal the maximum allowable individual campaign contribution, which is $2,000 to $6,000 depending on the office….

Another Green Energy Fail: Lalamilo wind farm in question

WHT: …A decision by the Hawaii County Water Board at its monthly meeting Tuesday may signal the end of an award-winning renewable energy project and prove the impetus for a legal battle with implications amounting to tens of millions of dollars.

The board found the Hawaii County Department of Water Supply (DWS) has complied with a power purchase agreement it entered into with the Lalamilo Wind Company (LWC) in 2013. That year, LWC won a bid to exclusively supply eight deep wells at the DWS Lalamilo-Parker Well Sites in South Kohala with clean, renewable wind energy.

Richard Hardin, member/manager at LWC, called Tuesday’s unanimous decision “very disappointing.” And he didn’t stop there.

“They think they’re prevailing in the short run, but in the long run they’re destroying the project,” he said of DWS, his company’s opponent in the matter the board decided on Tuesday. “Pitiful.”

Hardin added the board’s move is likely to spur a lawsuit on the part of his company….

Rate Hikes Coming: Hawaii to Hold Climate Change Meetings

The findings of the Permitted Interaction Group on ground transportation will be discussed.

The Permitted Interaction Group recommends legislation to establish a carbon tax such as increasing the barrel tax and to establish a state-funded study to lead to more accurate parking prices.

The nine members of the Permitted Interaction Group are: OEQC Director Scott Glenn, Hawai`i Department of Transportation Director Jade Butay, Hawaiʻi Department of Land and Natural Resources Director Suzanne Case, DBEDT Director Luis Salaveria, Hawaii County Planning Department Director Michael Yee, Honolulu Chief Resilience Officer Josh Stanbro, and State Senators Mike Gabbard, Lorraine Inouye, and Karl Rhoads.

The Greenhouse Gas Sequestration Task Force meeting for September 7th has been canceled.

The Honolulu Climate Change Commission will meet at Honolulu Hale 2nd Floor on September 18, 2018, from 3-5 p.m….

Maui Council OKs sand mining ban until end of year

MN: …Maui Lani, which opposes the bill, said it has a 400-unit housing project that is “shovel ready” but is being delayed by the moratorium, she said.

Issues over sand mining on Maui were brought to light in 2017 in a Honolulu TV news station report. It said that a contractor was removing and shipping truckloads of sand to Oahu from the site of Maui Lani’s housing project….

Pahoa evacuation shelter to close Sept. 17

SA: …The Pahoa Emergency Evacuation Shelter on Hawaii island is officially closing at noon on Sept. 17, Hawaii County officials announced today.

The shelter has been open since the Kilauea eruption began on May 3, and at one point housed more than 550 evacuees displaced by the lava flows.

Roxcie Waltjen, director of Hawaii County Parks and Recreation, said there were about 45 evacuees left in the shelter and that it was working with the American Red Cross, Salvation Army, Hope Services, the Office of Housing and Development, the Office of Aging and the Federal Emergency Management Agency to help resolve their housing issues.

“This has been the longest running emergency shelter in the history of Hawaii, and we will have been in operation for 138 days on Sept. 17,” Waltjen said….
