Court voids permit for construction of Thirty Meter Telescope

AP: The Hawaii Supreme Court is invalidating a permit awarded for the construction of one of the world’s largest telescopes on a mountain many Native Hawaiians consider sacred.

The court ruled Wednesday that the state Board of Land and Natural Resources should not have issued a permit for the telescope before it held a hearing to evaluate a petition by a group challenging the project’s approval.

The ruling sends the case back to the board for a new hearing.

CB: …State Homeless Coordinator Scott Morishige stressed at the Waianae Coast Neighborhood Board meeting on Tuesday, while also trying to reassure people that no sweeps are currently planned for The Harbor homeless (methamphetamines) community.

“We want to make sure we are getting everyone’s input before we settle on any specific strategy,” Morishige said.

The unique tweekers’ homeless village had already won a big ‘victory’ Tuesday night: Moments before Morishige spoke, the neighborhood board passed a resolution to support “the ongoing leadership of Twinkle Borge and Loke Lono for the Waianae Harbor Village.”

Later, after Morishige had stood patiently for close to an hour listening to people tell him to leave the community alone, the board passed a second resolution, this time calling for the state to give the community a lease on the land.  This time they recognized the community by the new name Borge and Chung-Lono have (been instructed to) given it: Puuhonua O Waianae. Puuhonua means sanctuary, and will also be the name of the nonprofit that (activists and lawyers using) Borge and Chung-Lono hope to create to pursue a lease.

(Old pattern:  Drive the homeless out of Waikiki & Downtown and push them into West Oahu.  Then act like the problem is solved.)

ACLU Homeless Sweep Lawsuit Going to Mediation

By agreement of the parties, Mediation is set for 12/18/2015 at 2:30 p.m. before the Honorable J. Michael Seabright.

Prior to the mediation the parties will submit confidential statements to Judge Seabright.

The case Martin v. City and County of Honolulu was brought by ACLU Hawaii and Alston Hunt Floyd & Ing in response to destruction of personal property during the City’s numerous sweeps of homeless encampments….

MN: …Shopping carts. A measure proposes to prohibit anyone from removing a shopping cart from the premises or parking area of a retail establishment without written consent of the owner. Other sections of the bill outlaw possessing a stolen shopping cart or abandoning it.

Public defecation or urination. A bill proposes to outlaw public defecation or urination in or on any public street, highway or sidewalk; or in a location owned or maintained by a government agency. (The bill has exceptions, including one covering people who failed to use a restroom or toilet because of a medical condition verified by a licensed physician.)

Lying on public sidewalks. A measure proposes to prohibit people from lying on a public sidewalk. (The measure has exceptions, including anyone unable to comply because of a medical condition or emergency or anyone engaged in "expressive conduct not otherwise disallowed under this code or state or federal law.")

Panhandling. A bill proposes to make it unlawful to solicit "in an aggressive manner in public places." …

Another bill would expand the county's law against consuming or possessing intoxicating liquor within municipal parking lots to "other public areas." These would include any public street, highway, sidewalk or any area or location owned or maintained by a government agency.

The five bills have been placed on the council's Friday agenda.….
