University of Hawaii Study: Native Hawaiians Fear Violence

Results in a pilot study "Native Hawaiian Perceptions of Violence as a Means to Attain Sovereignty" show a sharp contrast between the number of Native Hawaiians interviewed who believe violence is justifiable to achieve sovereignty -- 6 percent -- and the number who believe "the desire to gain sovereignty will result in violence in the future -- 53 percent. Only 24.8 percent felt that violence would definitely not occur.

Based on Admission Act, 9th Circuit Court of Appeals decision announced yesterday upholds the State’s right to create OHA.  The use of the Admission Act to support this decision undermines the argument that an Indian tribe must be created to protect Hawaiian programs against discrimination complaints.  In this regard it is similar to the US Supreme Court decision in the Ceded Lands case.

Meheula memo questions Ed Case's record on Hawaiian entitlements

Meheula’s memo says: “In the late 1990s, when Ed Case was chairman of the State House Committee on Hawaiian Affairs, he repeatedly acted to reduce Native Hawaiian benefits, rights and revenues…. In the 1998 legislative session, Mr. Case proposed the 123-page ‘Native Hawaiian Autonomy Act.’ The Act would have terminated OHA and the Hawaiian Home Lands program, denied Native Hawaiians the right to self-determination and federal recognition, and reduced State liabilities to Native Hawaiians. The Act stated that its purpose is to stop the ‘continued dependence by native Hawaiians on others which prevents the development of the full potential of the native Hawaiian people.’”

Maui County Council joining 'Reinstated Hawaiian Kingdom'?

Baisa's motion is not mere symbolism.  Section Nine of the proposed ordinance reads:

"The transition of the County of Maui from the jurisdiction of the United States to the reinstated Kingdom of Hawaii will occur over a term of four years, having commenced on February 1, 2009.  All county officials and employees shall retain their positions during this transition period."

Supreme Court ruling shields Hawaiian Homelands and ceded lands revenue

The high court’s reading of legal precedent gives special protection to a state’s Admission Act. And in the case of Hawaii this means special protection for Hawaiian Homelands and the designation of ceded lands revenues for five specific purposes. The high court thus undermines two of the three key public arguments for the Akaka Bill.

OHA Trustees and staff left at 7PM to “catch a flight.” In contrast, Rep Mele Carroll said she was staying “all night if necessary.” Said Carroll, “If I gotta hear the raw stuff that’s OK too. We don’t get out enough.”

The Advertiser quotes Bill Meheula, a key player in Dan Akaka's 2006 reelection campaign and Lilian Kame'eleihiwa, of the UH Hawaiian Studies Dep't who ague that OHA has a claim to ceded lands and seem to imply that the State has taken a new position in its appeal to the US Supreme Court requesting the Court overturn the Hawaii Supreme Court ruling blocking the state from selling ceded lands.

Earlier this year, OHA officials, led by Trustee Don Cataluna, blocked Kauai County from building a residential drug treatment facility for juveniles on a former Humane Society site about a half mile from Kauai’s Hanapepe Salt Pond. This as young Hawaiians and non-Hawaiians are literally dying from methamphetamines and other drug abuse.

Office of Hawaiian Affairs Blocks Kauai Drug Treatment Facility

Kauai residents, including minors, have been required to leave the island for inpatient drug rehabilitation services ever since Serenity House was destroyed by Hurricane Iniki in 1992. After 14 years of waiting, Kauai Mayor Brian Baptiste broke ground on a new inpatient treatment facility at Hanapepe near the Salt Ponds in August 2006.

But now, thanks to the Office of Hawaiian Affairs (OHA), construction has been halted and the location may be abandoned.
