THREE MONTHS after Intajak arrived in America, in October 2004, Global Horizons sent him to Hawaii to work for the Maui Pineapple Co. In 2004, Hawaii required 677 signatures to qualify an entire new party, and 3,711 signatures to qualify an independent presidential candidate.  Ralph Nader and Michael Peroutka each tried to qualify as independent presidential candidates.  Even though each of them submitted more than 7,000 signatures, Hawaii elections officials invalidated over half of them.  Hawaii tends to disqualify signatures if the signer failed to show either the last four digits of his or Social Security number, or the full birthday.

Hawaii’s usually voluble homegrown secular humanists are stone silent because they agree with Ka’auwai.  For the same reason, Hawaii’s pro-Abercrombie media have greatly tempered their response.  In a recent Star-Advertiser poll, Republican crossover voters were shown to be backing Mufi Hannemann 72% to 28% against Neil Abercrombie.

But the national groups aren’t thinking about short-term local political calculations....

Just in time for September 11th, the State of Hawaii, Department of Land and Natural Resources, has announced a six-figure grant to the 9-11 truthers of the Malu Aina Peace Center.

The Republican Governors Association launched new television and radio advertisements in Hawai‘i today highlighting Duke Aiona’s plan to reduce the state’s dependence on oil and move it towards a green energy economy.

Lt. Governor Aiona on Thursday delivered remarks on the importance of providing affordable, quality health care at a dedication ceremony for a new Shriners Hospital for Children in Honolulu. The hospital will help provide specialty care and innovative research for children from Hawai`i and the Pacific Northwest.

Alaska's incumbent Republican Senator Lisa Murkowski has conceded to TEA Party-backed Republican Senate candidate Joe Miler.

In his response, Abercrombie said that his opponent "spins facts."

"Congress.org is a Republican front organization that rates me in the same category as Sen. Daniel Inouye," he said, referring to Hawaii's longtime senator.

The Akaka bill is novel in that it is the first Congressional attempt to federally recognize a non-Indian entity, and to do so in a fashion inconsistent with the political history of the former governing entity it is ostensibly recognizing. Under a different view, the Akaka bill is novel in that it endeavors to federally recognize a government to collectively represent an entire ethnic group based upon shared indigeneity, rather than political history. But political history, not indegeneity, begets federal recognition.

HONOLULU -- With Hawaii's primary election just three weeks away, elections officials were dealt a big blow Friday by the federal government.

The state may face a federal lawsuit because Hawaii’s primary and general elections are too close together to meet the requirements of a new federal law….

Results in a pilot study "Native Hawaiian Perceptions of Violence as a Means to Attain Sovereignty" show a sharp contrast between the number of Native Hawaiians interviewed who believe violence is justifiable to achieve sovereignty -- 6 percent -- and the number who believe "the desire to gain sovereignty will result in violence in the future -- 53 percent. Only 24.8 percent felt that violence would definitely not occur.

HONOLULU – Governor Linda Lingle congratulated the Waipio All-Stars Little League team for winning the U.S. Championship Little League World Series title today, in a 10-0 shutout victory over the team from Pearland, Texas. ...

Usually discussions of Hawaii’s one-party system focus on an alleged “plantation mentality” and Democrat “machine voters.”  A caricature of the machine voter has them giving up their vote on instructions from nefarious union bosses in exchange for a plate of chili and rice.  But a recent poll points in a surprisingly different direction—wandering Republicans.  The Star-Advertiser-HNN poll released August 22 shows that Republican crossover voters back Mufi Hannemann 72-28% – making the Republican voting bloc absolutely indispensible to Hannemann’s Primary election chances. 

New Jersey was not the only state to lose out because of the Obama administration's slavish devotion to teacher union votes and cash. Proven education reform leaders like Louisiana and Colorado also lost points and finished out of the money because their state's chosen reforms threatened union priorities. Meanwhile Hawaii (which the Data Quality Campaign ranked 17th for education data systems, which the National Alliance for Public Charter Schools ranked 34th for the strength of their charter laws, and which got a D- from the National Council on Teacher Quality) finished third and will receive $75 million. Oh, but they had 100% "buy in" from the unions.

“Mr. Carlisle is fortunate that his statements about his involvement in the Republican Party do not have to stand up in court.   Although he claims that he was not an “active member” and only involved for a “few months”, the fact is Carlisle was a registered party member for 4 years, chaired two State Republican Party Conventions, emceed a major party fundraiser, and ran as a party member for reelection in 2008."

In an odd sequence of events, Republican Lieutenant Governor candidate Adrienne King last week first claimed and then retracted her claim to have won the endorsements of both the Kona and Maui TEA Party groups.  Rep. Pat Saiki, Honolulu’s Republican Congresswoman from 1986 to 1990, also rejects King’s continuing use of Saiki’s name as an endorser.  

"Even Mr. Carlisle, who promises to 'put our financial house in order' admits this is not fiscally responsible.  Despite this, he wants to build a mega rail system--even bigger than the one currently planned.

"It is our belief that Hawaii’s political class is purposely waiting until after the elections, at which time it will announce a 'November surprise' of massive tax increases to pay for rail, sewers, and pay increases."

TRENTON — New Jersey was not the only state to make an error on its application for the Race to the Top competition. Hawaii omitted a response to an entire section of the application it wrote for the competition’s first round, a mistake that cost it 25 points....

Hawaii politicos have spent a lifetime snagging federal dollars and then doing what they please, so it is illogical and unreasonable to assume that RTTT will be any different. 

The HSTA’s worthless signature was a key to the DoE’s RTTT application being ranked third in the nation, how will they undo it?

While a poll released today by the Honolulu Star-Advertiser shows Duke Aiona leading among Independents and Hawaiians in the race for Governor, it is geared toward 70 percent of an electorate preparing for a contentious Democratic primary election.

Of the 604 likely voters polled, 425 said they were planning to vote in the Democratic primary.

“While today’s news is promising, it is just the beginning. The road to success in the public school system is long, but with the kind of resolve that the State of Hawaii has displayed, it is not one that is impossible.”

“Securing this grant is just a stepping stone.  We will now begin the hard work of implementing our education reform plan, which includes a common core curriculum tied to a new on-line state test while tracking student progress and rewarding teachers by linking 50 percent of their evaluation to student achievement.  I am especially excited about our pledge to have 100 percent of high school graduates ready for a career and college without the need for post secondary remediation programs,” the Governor added.

“We outlined an ambitious vision and long-overdue public education reform goals for our state, which included assisting struggling schools, improving school performance from kindergarten to college, and ensuring that all of our students are equipped and prepared to enter both college and the working environment.

“This is an historic opportunity, and we must continue to work together to implement the reforms necessary to cultivate a brighter future for our young people.”

In response to the Star-Advertiser/Hawaii News Now poll released today (Sunday), the Hannemann campaign has released the results of a recent poll conducted by QMark Research that shows the race for governor in a statistical dead heat between the two leading Democratic candidates.

The QMark poll shows that if the race was held today it would be 43% for Abercrombie to 41% for Hannemann, a difference of two percentage points, with 16% of the voters still undecided.

I like Panos Prevedouros: his energy and enthusiasm; outside-politics base and perspective; and fresh thinking and independence. We need him and many others like him to seek and serve in elective office. In this election, though, he and Carlisle are the change candidates against a status quo Caldwell; I don't want that vote to be split at the risk of Caldwell prevailing. As well, as a cautious mass transit supporter, I don't believe rail should be effectively scuttled on this vote. So for me Prevedouros is a yes, but not this one.

Dr Thom Curtis, Chair of the UH Hilo Sociology Department, gave the August address to the Conservative Forum for Hawaii on the topic of “Home-Grown Terrorism” on Sunday, 22 August....

After his speech, which dealt entirely with Islamist terrorism, the meeting was disrupted by many Hawaiian Sovereignty proponents who dominated the session with loud and acrimonious statements and prevented the usual civil discussion expected of the topic.

Washington- In another attempt to distract from their record of runaway spending and economic failure, House Democrats have handed down new marching orders to Democratic candidate Colleen Hanabusa. Their latest strategy to gloss over their job-killing agenda is to instruct loyal followers like Hanabusa and her Washington friends to highlight the party’s so-called small business agenda. Likely missing from the latest directive, however, is any mention that Washington Democrats are pushing forward with a plan to slam small businesses with massive tax hikes that are certain to kill jobs, prevent businesses from hiring, and set the already-struggling economy back even more.

"Now, Ed has written a thoughtful and courageous letter to his supporters about why he is endorsing Neil Abercrombie over Mufi Hannemann in the Democratic primary. Ed is candid in describing Mufi as "the product and clear choice of a political machine that must end" and "the most dangerous politician in a generation."

...I've known and worked with Hannemann for the same period, and once saw him as a leader for Hawai‘i today and tomorrow. But, as I've watched him in public office, I've come to view him as the most dangerous politician in a generation, because his talents mask an agenda which, if successful, will set Hawai‘i back a generation. He is the product and clear choice of a political machine that must end....

House Republicans this weekend continued to blame Democrats for a lethargic economy, charging that last year's stimulus bill has hobbled the country with debt while failing to prevent the job losses that supporters promised.

"For every problem facing our nation, the answer from Washington has been to spend and spend, and – if that doesn’t work – spend some more," Rep. Charles Djou (R-Hawaii), said Saturday, delivering the Republicans' weekly radio address.

Wall Street Journal, New York Times, Voice of America, AP, Bloomberg, Politico...they're all talking about Charles Djou's speech.  And the local media?  Oh, that's right, they're busy doing point-by-point color commentary on the trash-talking Democrats who want to be Governor.

Rep. Djou: “Even if the powers-that-be in Washington do not support less government and less spending, they should at least provide those of us who do with a chance to give the American people the common-sense fiscal discipline they are demanding.”

Citing 50-year-old “gossip” as its source, The Honolulu Advertiser August 9 tries to convince readers that, “the main opposition to statehood was posed by Native Hawaiians still stinging from the illegal overthrow of their monarchy and the subsequent annexation of Hawai'i by the United States, and by the territory's white elite, who feared that statehood might compromise their standing.”

In reality the miniscule 6% opposition to Statehood in 1959 was motivated by a fear of elections. Opponents preferred to continue with a Territorial government consisting of officials appointed by Washington rather than a State government elected by voters who were heavily Japanese-American and heavily tied to plantation labor. Opponents of Statehood were landed aristocracy fearful of being ruled by their employees.

The Hawaii Newspaper Guild and the Hawaii Tribune-Herald have signed a contract after nearly six years of negotiations.

The two-year agreement covers all employees at the Hilo newspaper except pressmen, who are covered by a separate contract, and managers. The pressmen's negotiations lasted as long as the Guild's. The contracts are similar.

"The poll numbers referenced by Mr. Carlisle in the Midweek story do not exist.  The Hawaii Republican Party has not conducted nor shared poll numbers with the Carlisle campaign and the public needs to know that the numbers he is referring could just be made up."

Peter Carlisle is not a member of the Hawaii Republican Party.  The only Hawaii Republican Party member in the race for Honolulu Mayor is Panos Prevedouros.

The King campaign has retracted its earlier announcement of endorsements from both the Maui and Kona TEA Parties.

“For too long, the State of Hawaii has had to bear a disproportionate burden in providing social services for Micronesian citizens who are legally allowed to travel to the United States without visas. While Micronesian citizens comprise less than 1% of Hawaii’s population, they consume over 20% of Hawaii’s social services. This burden is simply unfair to the taxpayers of Hawaii...."

The Hawaii Family Forum | Hawaii Catholic Conference surveyed candidates running for the US Congressional districts, Governor and Lt. Governor, House and Senate and the Board of Education.  These are their answers ...

He will propose legislation to place time limits on the issuance of permits and approvals that will increase efficiency and effectiveness in state government. If a permit or approval is not issued within the allotted time period, the application will be automatically granted.

He will post online all updated permitting and approval guidelines and procedures, create an online tracking system, put all state permits and leases online in a searchable database and subject all tax credits and public grants to public quarterly reporting.

Since taking office the Obama administration has used the Troubled Asset Relief Program (TARP) and other initiatives to buy one car company, give another to union allies, punish non-union workers, undermine the bankruptcy code, enrich Wall Street at the expense of Main Street, bail out Mickey Mouse, keep unionized zombie firms from dying and generally terrorize the world economy. That is why, for the first time ever in 2010, the United States fell from the ranks of the economically "free," as measured by The Heritage Foundation's Index of Economic Freedom.

Standing out in the ratings are the “Dirty Dozen,” which include states that have not addressed the crime of human trafficking at all (Hawaii, Massachusetts, South Dakota, West Virginia, and Wyoming). The remaining states (Alaska, Arkansas, Colorado, Ohio, South Carolina, Oregon, and Virginia) criminalize only sex trafficking or labor trafficking but not both, only include human trafficking as a mere sentencing enhancement, or have laws that are too weak or so narrowly drafted that investigations and prosecutions of human trafficking cannot proceed. Conversely, states that have taken the most action to combat human trafficking in a comprehensive way include Connecticut, Minnesota, Texas, and Washington, among others.

Editor’s Note: In other words, if Mufi Hannemann is the Democrats’ nominee for Governor, he will become the next Dan Inouye and  Hawaii will be under his thumb for the next 20-30 years.  Without a Hannemann victory, there is no Democrat ready to become the next Inouye and Hawaii will become a two-party democracy.

FACT: Since Senator Inouye took control of Government Spending as Chairman of the Appropriations Committee in 2007, the Federal Debt has grown 50% and the Federal Deficit has grown 900%!

FACT: Twice in the past year, Senator Inouye voted to increase the Debt Ceiling by a total of $2.1 TRILLION.

FACT: Senator Inouye has voted AGAINST a balanced budget amendment four times.

Regardless of whether one agrees with the result, structurally sound opinions always confront binding legal precedent. Walker's is a clear exception because the U.S. Supreme Court has spoken on whether a state's refusal to authorize same-sex marriage violates the equal protection and due process clauses of the 14th Amendment. In 1972, Baker v. Nelson, a case over whether Minnesota violated the Constitution by issuing marriage licenses only to opposite-sex couples, was unanimously thrown out on the merits, for lack of a substantial federal question. The Supreme Court's action establishes a binding precedent in favor of Proposition 8. But Judge Walker's ruling doesn't mention Baker, much less attempt to distinguish it or accept its findings.

I am the child of immigrants, a citizen by birth, and at age 39 I proudly placed my hand on the Bible and swore to protect our Constitution as a member of the U.S. Congress. My story is not unique. For more than 200 years our ancestors abandoned their homes and risked their lives to come here, work hard, and provide a better life for their families. The opportunity to do so is part of what makes our country the greatest on Earth.

I understand that our immigration system is broken and share the frustration of so many Americans with our porous borders. America needs comprehensive immigration reform; it is critical to our nation's future. But it is simply unrealistic to believe that we can fix the problem by amending the Constitution.

It took 15 months, but the Advertiser has finally slipped up and mentioned the possibility that the scheduling of Hawaii Islam Day had something to do with celebrating Islam on September 11.  Even better, Volcanic Ash columnist David Shapiro August 11 ruefully admits:

“state Rep. Lyla Berg is still taking grief in her campaign for lieutenant governor for a resolution she sponsored declaring last September 24 as Islam Day.”

If confirmed by the results of the September 18 Democratic Primary, this will be good news.  It is also a teachable moment. 

Justice Recktenwald has served on the Hawaii Supreme Court since May 11, 2009. Prior to that he served as Chief Judge of the Intermediate Court of Appeal from April 30, 2007 until his confirmation to the Hawaii Supreme Court.

The following is a brief run down of the cases Justice Recktenwald authored during his time on the Hawaii Supreme Court ....

In County of Hawaii v. Ala Loop Homeowners, (July 9, 2010), the Hawaii Supreme Court held that certain state zoning laws are "environmental" laws that may be enforced by private plaintiffs. The court held "[w]e further conclude that article XI, section 9 of the Hawai'i Constitution creates a private right of action to enforce chapter 205 in the circumstances of this case."

Companies including AIG, Lehman Brothers, Wachovia, JP Morgan, Morgan Stanley, Union Bank, Wells Fargo and others essentially buy tax benefits from solar (and wind) companies that don’t have enough taxable income to use those credits on their own. Tax-equity investors get to use those tax credits as part of a strategy to shelter otherwise taxable income. (Sounds just like Hawaii ACT 215/221)

In both of his prior confirmation proceedings, Recktenwald was unanimously confirmed by the State Senate (25-0 for chief appellate judge and 22-0 for associate justice).

Prior to his appointment to the Intermediate Court of Appeals, Recktenwald served as the director of the Department of Commerce and Consumer Affairs (2003-2007).  During his tenure, he focused on expanding protections against identity theft and enforcing Hawai‘i’s consumer protection laws, including guarding against unfair and deceptive trade and business practices, and insurance and securities fraud.  He also worked to make the department’s services more convenient for the public by expanding and enhancing on-line services.

“My responsibility is first and foremost to represent the people of Hawaii and that is absolutely what I have been doing. I think what you saw in the special election is that the majority of the people didn’t vote against me. The overwhelming majority of the voters voted against the establishment. They didn’t like the status quo and felt that the current representation in Congress needs a fundamental change. That’s what I’ve been doing, and that’s who I’m representing. I look forward to the judgment of the voters again in November.”

After months of tortured evasions, Mufi Hannemann July 16 finally came out of the closet and announced that if he were Governor, he "guesses" he would "probably" have vetoed HB444 gay civil unions.

For just a moment, it appeared as if Hannemann had sort of taken a position--after refusals dating back to September, 2009.  But in yesterday’s Democrat Gubernatorial debate, Hannemann again reverted to his old waffly ways refusing to take any firm stance for or against HB444. 

This Bill will have the dubious distinction of being the first ever to lower SNAP benefits from one period to the following period. For the first time ever, SNAP recipients will see their monthly benefits shrink. A family of four can expect their benefits to drop about $59 a month starting in April 2014. ($59 x 12 = $708/yr)

Despite a categorical denial, evidence is mounting that leading Hawaii gubernatorial candidate Neil Abercrombie, is a covert socialist. What is worse, he may be lying about it.

Today the House of Representatives is expected to approve yet another bailout for those states that have proved incapable of controlling their spending on government worker pay, benefits and pensions. The $26.1 billion price tag will be funded in part by $11 billion in tax hikes on U.S. companies that compete internationally.

"The HGEA Union Bosses have made it clear that a prerequisite for their endorsement is a commitment from candidates to raise the GET tax in order to pay them off.  Hannemann, Schatz and Caldwell need to come clean with Hawaii voters and tell them how big of an increase they promised so we know just how much more in taxes we can expect to pay if they get elected."

"... in order to pay for this latest $26 billion bailout of states, the Democrat-controlled Congress cut almost $12 billion from the Supplemental Nutrition Assistance Program (formerly known as food stamps), at a time when a record number of Americans – including almost 141,300 Hawai‘i residents – depend on this assistance to subsidize their food purchases.

(08/10/10) HONOLULU – A comprehensive settlement has been reached with the City and County of Honolulu that will address Clean Water Act compliance at Honolulu’s wastewater collection and treatment systems, the Justice Department, U.S. Environmental Protection Agency (EPA), Hawaii Attorney General’s Office, Hawaii Department of Health, and three environmental groups announced today.

The settlement which also resolves lawsuits brought by the Sierra Club, Hawaii’s Thousand Friends and Our Children’s Earth Foundation, includes a comprehensive compliance schedule for the city to upgrade its wastewater collection system by June 2020. Under the settlement, the Honouliuli wastewater treatment plant will need to be upgraded to secondary treatment by 2024. The Sand Island plant will need to be upgraded by 2035, but could be extended to 2038 based on a showing of economic hardship.

“The problem in Congress today is that it seems that the universal answer to every one of our nation’s problems is spend, spend, and—if that doesn’t work—spend some more. And this particular bill that we’re voting on today fits exactly in that genre—‘Spending can fix all of our nation’s woes.’

U.S. District Judge Vaughn R. Walker, who ruled last week that a voter-approved amendment to California’s constitution that limited marriage to the union of one man and one woman violated the Fourteenth Amendment of the U.S. Constitution, based that ruling in part on his finding that a child does not need and has no right to a mother.

Nor, he found, does a child have a need or a right to a father.

According to the study, 186 special funds spread across twenty different departments hold an estimated $1,412,357,203 in unspent revenues over and above their operational requirements. Some of the special funds were tagged by the auditor almost a decade ago for repeal.

Congressman Djou articulated his concerns about the impact of Micronesian immigration to Hawaii on the City and County of Honolulu and the State of Hawaii's social service programs. Congressman Djou and Ambassador George both acknowledge that the status quo is not working.

Washington- The Obama White House promised this would be a summer of economic recovery, but after another disappointing month of high unemployment it is evident that is simply not the case. Now, Hawaii families can add another false promise to their growing list of grievances against Colleen Hanabusa's out-of-touch Democrat friends, whose runaway spending addiction has led the economy astray. With unemployment standing at 9.5 percent and over 130,000 jobs lost last month, Hawaii families are feeling burned by Hanabusa's Washington friends, whose trillion-dollar stimulus has failed to bring them out of this jobless recovery.

“Democrats in the Senate have tried every trick in the book to prevent Governor Linda Lingle from appointing the next Chief Justice. They put a question on the ballot to change the retirement age for judges which was voted down by voters and now they are trying to vote down an obviously qualified judge, with Judiciary Chair Brian Tanaguchi telling the media after the hearing that the five men on the list were all qualified. This is height of hypocrisy."

But Pelosi agreed to offer her support when the Abercrombie camp sought to counter a tough ad that attacked Abercrombie’s attendance record in the House, his March resignation from Congress to run for governor, and calls him a “follower.”   (Gee. I wonder where they got THAT idea?)

Three months after Rep. Charles Djou (R-Hawaii) won a key special election in one of the blue state's two House districts, the RGA is signaling that it thinks it can win that state's governor's race too.

The TV and radio ads are 100 percent positive and don't mention Lt. Gov. Duke Aiona's (R) Democratic opponents. They feature Aiona himself and talk about his efforts to control drugs in the state.

“In these tough economic times, people want ideas and solutions.  Duke Aiona’s creation of the Drug Court is an example of finding a better way to improve lives.  People want their leaders to be positive, not divisive and negative.  That’s what Duke’s whole life has been about.” 

This Tuesday voters in Missouri, by a 40-point margin, approved a ballot measure rejecting the individual mandate at the core of President Barack Obama's health care law. Asked what the vote meant to the White House, press secretary Robert Gibbs said: "Nothing." Yesterday in San Francisco, federal judge Vaughn Walker gave the exact same weight to a California ballot measure that affirmed marriage as an institution between one man and one woman. Specifically Judge Walker overturned the California Marriage Protection Act after concluding, as a matter of fact, that the majority of Californians who voted to protect marriage were bigots who had no rational basis to define marriage on their own terms.

Could Sen. Dan Inouye be next?  The US Senate equivalents of the Waters charges could easly be brought to bear against him if the political will exists.  While Waters was allegedly seeking help for her husband’s bank, Inouye allegedly sought help for Central Pacific Bank.  At the time, CPB stock made up an estimated 66% of Inouye’s personal net worth.

“The Hawai‘i State Bar Association’s (HSBA) ‘unqualified’ ratings of Judge Katherine Leonard and Judge Faauuga To‘oto‘o are outrageous and are clearly not based on the legal experience and qualifications of these two highly qualified nominees,” said Governor Lingle.

“The State Bar Association’s review process was unfair, flawed, and conducted under a veil of secrecy, with no accountability to the public.  The HSBA has refused to state its reasons for its ratings.

Adoption of national standards by states appears to be only an attempt to gain federal grants—not real reform. But in taking Washington’s money, are states sacrificing their educational autonomy for short-term budgetary security?

Just two-and-a-half months after winning his special election in HI-01, a new poll from Rep. Charles Djou's (R) camp shows he starts the general election in a rather strong position. In the survey, Djou led state Senate Pres. Colleen Hanabusa (D) 50-42%.

HONOLULU - Lt. Governor Duke Aiona today announced that he has raised more than $370,000 in the first six months of 2010, including more than 1,350 donations of $100 or less. In the last six months of 2009, Duke Aiona raised nearly 950 donations of $100 or less.

Aiona has raised more than $2.3 million during his gubernatorial campaign. Approximately 88 percent of his donations have come from Hawai`i residents.

Aloha State conservatives still have a 7% edge—28% to 21%--over liberals.  Hawaii’s 47% of self-identified moderates tops the nation. 

Mainland gay activists are doing everything they can to make sure that Hawaii remains under the thumb of child-molester advocate Rep Joe Bertram (D-Kihei) and HB444 sponsor Rep Blake Oshiro (D-Aiea).  The multi-million dollar Washington, DC-based Gay & Lesbian Victory Fund names Oshiro as one of its “featured candidates” pumping mainland gay money into Oshiro’s campaign as he faces off against a strong Democrat Primary challenge from Honolulu Councilmember Gary Okino, a firm opponent of HB444.

When researcher Trevor Loudon in a July 12 NewZeal article posted at Hawai’i Free Press brought out evidence that Neil Abercrombie has for years been a secret member of the Democratic Socialists of America, the “birthers” at World Net Daily, were quick to cover the story--thus providing Abercrombie with the handy foil Abercrombie needed to falsely dismiss Loudon’s questions as the rantings of conspiracists. 

HONOLULU – Governor Linda Lingle today heralded the designation of the Papahānaumokuākea Marine National Monument by the United Nations Educational, Scientific and Cultural Organization (UNESCO) as a World Heritage Site, as another major milestone in the continuing effort to protect and preserve one of the most historically and culturally significant resources of Hawai‘i.  Papahānaumokuākea was inscribed as a World Heritage site at approximately 3:30 p.m. HST on Friday, July 30, 2010.

Hawai‘i has become one of the least business-friendly states in America. Having served in the Hawai‘i State House and on the Honolulu City Council, I know that we cannot continue to punish businesses and still provide for a prosperous Hawai‘i.

But the anti-business policies that I fought in state and local government are dwarfed by the tax-and-spend agenda that I am battling in the United States Congress. It seems that for every problem facing our nation, the government’s answer is to spend and spend some more.

President Obama has quietly been reworking the country’s education system, doing an end-run around normal legislative procedure. With the U.S. Department of Education’s (DOE) funding doubled thanks to the so-called "stimulus," the Administration has little need or incentive to bother negotiating its education agenda through Congress. Instead, the DOE is using that windfall of funding and power to stage a significant overhaul of local schools; dangling grant money before cash-strapped states on the condition they adopt key pieces of the Obama education agenda.

Lambda legal staff attorney Tara Borelli: “Because of the way Hawaii’s constitution was amended in 1998, that amendment reserves for the legislature, the decision about whether to allow marriage equality for same-sex couples. So we aren’t able to ask the court for marriage equality, it’s a case instead that seeks access to the complete package of legal tools to protect families.”

Hawaii state Senate President Colleen Hanabusa, who split the Democratic vote with former Rep. Ed Case in the May special election, is the party's presumptive nominee against Djou.

"We now have sweetness and light in Hawaii — or at least we don't have a lot of darkness," Hoyer said.

In what appears to be a deliberate new strategy, gay legal groups are targeting some of the states that have banned marriage by constitutional amendment. In Montana, (and now Hawaii) the ACLU sued the state for equal rights on behalf of several same-sex couples, arguing that even if marriage was foreclosed by law, the equality principles in the constitution still require that Montana offer all the rights and benefits of marriage to gay couples, short of the name itself.

In David Shapiro’s July 28 column, he implies that Governor Linda Lingle’s legacy will be narrowly defined by her judicial appointments. While Shapiro correctly points out that the Governor has appointed 3 of the 5 Supreme Court Justices, pending Judge Katherine Leonard’s confirmation as Chief Justice, 5 of the 6 judges on the Intermediate Court of Appeals and more than half of the Circuit Court judges, he is vastly overlooking the Governor’s many other accomplishments of her nearly 8 year service.

Congressman Djou’s amendment would’ve restored, through offsets, the necessary funding to one of the largest movements of military assets in decades while helping to maintain a robust military presence in the Asia-Pacific region.

Congressman Djou’s amendment would’ve increased funding for military construction projects necessary to realign Marine Corps forces to Guam.  The funds would come from offsets within H.R. 5822....

As Ian Lind notes, "Mainstream media haven't told us much about Chief Justice nominee's legal views" and "[t]he only thing I’ve seen about Leonard’s actual judicial performance and views was a review of Leonard’s decisions from the legal blog, Inversecondemnation.com." The only other coverage we've seen has been further references to our post by law blogger Charley Foster at Planet Kauai, and by alternative journos Hawaii Reporter and Hawaii Free Press. The only words we've heard from traditional media has been from the Star-Advertiser's Dave Shapiro, and then primarily via his Volcanic Ash blog.

Based on Admission Act, 9th Circuit Court of Appeals decision announced yesterday upholds the State’s right to create OHA.  The use of the Admission Act to support this decision undermines the argument that an Indian tribe must be created to protect Hawaiian programs against discrimination complaints.  In this regard it is similar to the US Supreme Court decision in the Ceded Lands case.

“Raising $3.8 trillion in new taxes at any time is a bad idea. Raising these taxes in the middle of an economic downturn is a terrible idea. The current majority in Congress has spent hundreds of billions of dollars to try and turn around the economy with the so-called ‘stimulus’ package. It has utterly failed.”

During the most recent legislative session, the Republicans in the State Legislature introduced bills calling for a periodic comprehensive review of the DOE. Despite the groundswell of support from parents, students, and teachers for the Republican bills, the Democrat Majority in the Legislature allowed these bills to expire in committee without any explanation. What are they afraid an independent auditor will find? As Lieutenant Governor I will support Duke Aiona's goal for an independent audit of the DOE. An independent audit has not been conducted since 1973. The audit must be comprehensive, and include examining financial and management practices, and personnel administration. I will fight to make sure the audit is released to the public.

In 2009 the US House Energy and Commerce Committee nailed Sandwich Isles as one of the nation’s “10 worst abusers” of Universal Service Fund (USF) tax dollars—which every telephone customer pays with their monthly phone bill.

SIC’s cables run to Hawaiian Homelands properties-most of which are unoccupied and are not going to be occupied anytime soon.  The cost per actual user of broadband services is estimated at $278,000 per customer.

HONOLULU – Governor Linda Lingle today appointed Caroline S. Wong to the Board of Education to fill the seat vacated by Breene Harimoto, who resigned last month.  Wong will serve on a temporary basis until a new member is elected in the November General Election to serve out the remaining two years of Harimoto’s term.  Her appointment takes effect immediately.

The legislation penalizes entities that assist Iran in importing refined petroleum or in maintaining or expanding Iran’s domestic refining capacity. These sanctions penalize foreign financial institutions that do business with Iran’s Islamic Revolutionary Guard Corps, aid Iran’s nuclear program or support Iran’s sponsorship of terrorism. I was proud to join my colleagues on both sides of the aisle in supporting these sanctions.  

The bill that I co-sponsored has now become law, signed by the President on July 1, 2010.  

The DoE is paying millions of dollars to contractors for software when equal or superior alternatives are available elsewhere at lower cost--often free of charge. This wasteful spending is the direct result of the cozy, revolving door relationship between the contractors and the DoE officials who direct business their way.

We've done an informal survey of the 2010 output of the ICA (and the Supreme Court in reviewing the ICA's work) to pick out those cases in which Judge Leonard authored the opinion, or served on the panel in an interesting case. We tried to focus on published opinions, but there were several unpublished opinions which also caught our attention. Here are the results, in reverse chronological order:

Each legislator has been scored based on his or her performance in the 2010 legislative session. Scores indicate the percentage of votes in which legislators voted in favor of limited government and greater individual liberty. While a few legislators seized the shortfall as an opportunity to make tough spending decisions, the vast majority voted to continue for the status quo-excessive spending and even higher taxes for the people of Hawaii.

Hawaii’s natural advantages continue to mask its political failings.

Setting snark aside, there is a real issue here: Is it appropriate for a state to require parents to declare their races so they can be stamped on to their children’s birth certificates, where they will remain in perpetuity? As of 1993, only five states had such policies in place. Now, over 15 years later, we have a multiracial president in the White House. Is it still necessary to insist upon racial identification on birth certificates — or is it time to discard such policies as outdated and counterproductive?

What valid purposes are served by such policies? Don’t they just exacerbate the problem of excessive race-consciousness in this country? To quote the wise words of Chief Justice John Roberts, “[t]he way to stop discrimination on the basis of race is to stop discriminating on the basis of race.” And the way to stop discriminating on the basis of race is to stop knowing or caring what race a person is. [FN1]

Ms. Leonard, who turns 51 next month, joined the Intermediate Court of Appeals after Governor Lingle nominated her in November 2007 to fill a vacancy created by the death of Associate Judge John Lim.  She was confirmed unanimously (23-0) by the Senate and took her seat in January 2008.

The FTA has said that the City’s current financial plan is insufficiently robust to warrant entry into the next stage, Final Design. The Governor has said that she needs to see a plan that is robust enough to warrant entry before she will “accept” the Final EIS.

Mufi can continue this standoff by not having the City produce a new financial plan; Caldwell will do what he is told. Mufi can then continue to blame the Governor for holding up the project while deflecting blame from himself.

This case did not garner the broad public interest of the Superferry litigation, but the case could be more important. The core issue in the case was whether Hawaii's statewide zoning laws are "laws relating to environmental quality" which may be privately enforced, or whether they are classic Euclidean zoning laws which can't.

It’s just hard for us skeptically-inclined old-timers in journalism to accept that a man with a City job and a history of doing “opposition research” didn’t even ask some high Hannemann campaign official if it was okay to portray Abercrombie as a brain in a glass jar controlled by former Gov. Ben Cayetano, as a “flailing gasbag” and his wife, the scholar Nancie Caraway, as “a witch.”

…And it’s just going to get nastier at least until the primary, perhaps beyond.

Hanabusa said that the Democratic Congressional Campaign Committee's preference for former Rep. Ed Case (D) in the special election was based on "bum information" in an interview with the Fix Monday. The Aloha State may be renowned as one of the most beautiful states in the Union, but that beauty comes at significant cost: the average Hawaiian paid out $1,010 in state taxes in the first quarter of the year, the highest of any state. The two biggest components to the state's revenues were income and excise taxes. 

The four politicians running for this office all have clearly represented their support of the status quo with even prosecutor/politician Peter Carlisle pledging to have rail all over the island and through the Koolaus. Is Peter's 30 Billion Dollar Rail Plan prudent fiscal policy for our Oahu?

I am the only candidate who is an engineer, not a politician, and I will stop the rail project, repeal its tax, and work with everyone who wants to make Honolulu the great city we all know it deserves to be.

Here are some questions for Abercrombie and Caraway:

At first blush, Hawaii’s First Congressional District doesn’t look like a potential Blue to Red conversion target. Obama did carry HI01 by a lopsided 70-28 percent spread, but that margin seems to be grossly distorted in favor of Honolulu’s Favorite Son. President Obama was born and spent some of his schoolboy years in this very district. 

Djou’s Honolulu-based district is historically Democratic, but it is not utterly inhospitable to Republican candidates. As the Washington Examiner’s senior Political Analyst Michael Barone mentions in his Almanac of American Politics, HI01 is home to “many military families in modest neighborhoods who may vote for Democrats but can be attracted to Republicans.”  

HONOLULU— Hawaii Republicans are celebrating candidate filing deadline this year with a bang. Hawaii Republican candidates are contesting nearly every seat in the State House and Senate.

“Mr. Speaker, the American people expect Congress to act responsibly and to be trustworthy. But how can this happen when this Congress has no plan?

“No plan for a budget. No plan to create jobs. No plan to turn around our economy other than to spend, spend, and spend some more of the people’s money.

“We spent more than a trillion dollars to ‘create jobs,’ but as of yet our unemployment rate still languishes at over 9.5%. Our nation is plagued with debt and not creating a budget further amplifies the problem."

Despite having served for less than two months, Hawaii Congressman Charles K. Djou is influencing national policy in Washington.  He has rapidly become one of the most active and outspoken representatives in the U.S. today.

Neil Abercrombie’s campaign is responding to reports that Abercrombie has been a secret member of the Democratic Socialists of America.

The company said it expected to settle the civil damages case for $137.5 million. That is in addition to $80 million WellCare agreed to pay in May 2009 to defer criminal prosecution on a felony charge of fraud. About half of that money went back to Florida health programs.

Hellein's complaint names other states besides Florida as victims of WellCare's fraudulent accounting — Illinois, Indiana, Louisiana, New York, Georgia and Hawaii.

“After more than 10 days of political maneuvering, Hannemann must have reviewed his polls and discovered that taking a clear stance on HB444 was politically beneficial. 

"Is this the kind of pono leadership Hannemann promises in his latest television ad?  Hawaii deserves a principled Governor who is not afraid to make decisions and take positions on controversial issues.”
