Full Text: Day v Apoliona Decision
By News Release @ 12:20 PM :: 6961 Views :: Akaka Bill, DHHL, OHA

Based on Admission Act, 9th Circuit Court of Appeals decision announced yesterday upholds the State’s right to create OHA.  The use of the Admission Act to support this decision undermines the argument that an Indian tribe must be created to protect Hawaiian programs against discrimination complaints.  In this regard it is similar to the US Supreme Court decision in the Ceded Lands case.

WSJ: Paradise Lost? A Project in Hawaii Stumbles
By Selected News Articles @ 10:12 AM :: 8888 Views :: Hawaii County , Akaka Bill, Energy, Environment, World News, Family

The final tally will become clearer later this month, when Bank of Scotland, now part of Lloyd's Banking Group PLC, completes an auction for the debt on the property on the west side of Hawai'i, or, as it is known to locals, the Big Island. The price is expected to be in the $50 million-to-$100 million range, according to people involved in the process.

In 2006, at the height of the real-estate boom, a private appraiser valued the property, known as Hokuli'a, at between $600 million and $800 million, according to people familiar with the matter. The owner, Lyle Anderson, a Phoenix-based developer, has sold about one-third of the lots. But in early January, he defaulted on its debt, which was in the form of a $1 billion Bank of Scotland mortgage on Hokuli'a and five other less-valuable properties, according to people involved in the project's sale.

Matsuura endorsement of Aiona underlines importance of social issues in Governor’s race
By Andrew Walden @ 2:42 PM :: 5943 Views :: Hawaii County , Akaka Bill, Energy, Environment

The Democratic Gubernatorial Primary features a confrontation between Neil Abercrombie and Mufi Hannemann.  Whether one sees this as a replay of Democrats’ 1986 Abercrombie vs. Hannemann demolition derby or as an echo of the current Case vs. Hanabusa CD1 cage fight, it is not difficult to see what Matsuura might mean by “politics or special interests.”

But what about the song?  “For the sake of the children” is a cry which has been used to justify many things.  Why might it now mean “Aiona for Governor”?

Akaka Bill: Aiona still concerned about Abercrombie’s new version
By Lt Gov Duke Aiona @ 2:53 AM :: 4909 Views :: Akaka Bill, Politicians

I share valid concerns with the 2010 Akaka Bill, including its limited definition of whom qualifies to be recognized as a member of the Native Hawaiian community; its ill-defined relationship between the Native Hawaiian governing entity and local, state and federal government; and its immediate establishment of sovereignty prior to further negotiations that could address outstanding issues like public safety, healthcare and property rights.

To achieve the type of broad-based support that this landmark legislation deserves, the amendments contained within the 2010 Akaka Bill should be fully vetted and resolved in the community through open and inclusive public hearings.

As an attorney and former state judge, I recognize that opponents of the 2010 Akaka Bill have rightly pointed out that failure to properly address these issues beforehand will likely result in difficult negotiations and protracted litigation following passage.

While my preference is for Congressional leaders to work out these issues before passing the 2010 Akaka Bill, I will continue to support the bill with reservations and work immediately to address any outstanding issues if elected Governor.

A highly funded, Washington, DC lobby organization, Food and Water Watch (FWW), is mounting a frontal attack on Hawaii State policy that supports open ocean mariculture. Aiona on New Akaka Bill: “I share objections regarding immunity and definition of Qualified Native Hawaiian Constituent”
By Lt Gov Duke Aiona @ 8:17 PM :: 5986 Views :: Akaka Bill, Politicians

“While I share valid objections regarding the sovereign immunity bestowed upon a Native Hawaiian governing entity and the amended definition of a qualified Native Hawaiian constituent, as provided in the 2010 Akaka Bill, I believe the proper balance of state and federal laws can be fully vetted and resolved in a manner that is consistent with the best interests of all of Hawai‘i’s citizens.

The Governor’s letter stated, “The explicit sovereign immunity and exemption from regulation provisions in the present bill allow the Native Hawaiian governing entity, and its leaders, to conduct activities anywhere in Hawai‘i (and potentially any other state) in a way that is inconsistent with State criminal statutes otherwise applicable to all citizens, and state laws governing narcotics and dangerous drugs; civil defense; alcohol and tobacco; fire and building codes necessary for public safety; traffic safety; landlord-tenant matters; clean air, clean water, hazardous waste (and other state pollution statutes); child welfare, child protection, and child safety; public health; food and drugs; and virtually every other conceivable law that serves to protect the public. It is not clear how the State could enforce its interests against unlawful or irresponsible actions by the governing entity or its elected leaders or employees."

Bought and paid for, will Hirono cast the deciding vote for Obamacare?
By Andrew Walden @ 1:40 PM :: 14354 Views :: Hawaii County , Akaka Bill, Honolulu County, Democratic Party, Kauai County, DHHL, Maui County, Education K-12, Energy, Environment, National News, Ethics

For months, Mazie Hirono pledged to vote against the Senate version of Obamacare.  For her, Senate Obamacare just wasn’t socialist enough.  Along with 56 other “progressive” members of Congress, she demanded a program with a public option and denounced the Senate bill as a multi-billion dollar giveaway to the insurance companies.

Hirono’s July 30, 2009 letter explained:

“Any bill that does not provide, at a minimum, for a public option with reimbursement rates based on Medicare rates--not negotiated rates—is unacceptable…. (T)his agreement will result in the public, both as insurance purchasers and as taxpayers, paying ever higher rates to insurance companies.  We simply cannot vote for such a proposal.”

Hirono has maintained this position as recently as February 2, but at the last minute, barely noticed by her “progressive” base, Rep Mazie Hirono has changed her mind....

Now, more than ever, we need to bring balance to our nation’s capitol.  For too long, Hawaii residents have been underserved with only “one” viewpoint represented in Congress.  This out-of-balance system has failed our citizens and allowed for policies that have stifled our creativity and economic growth and burdened us with heavy taxes, wasteful, out of control government spending, and inefficient bureaucratic growth.

The people are speaking, but Washington isn’t listening.  That’s why we need new leaders who will listen and provide “common sense” approaches to get our country back on track.  Join me in the “good fight” and allow me the honor to represent you with “a strong voice and presence” in the halls of Congress.

Obama voters a no-show at Hawaii Democratic caucuses

Two years ago, 37,000 people showed up to vote in the Democratic caucuses....  This year, if the House District 2 and 3 attendance is reflective of the whole, fewer than 2,000 people will have shown up Statewide.

Reservation for a Broken Trust?
By Andrew Walden @ 12:07 AM :: 15015 Views :: Akaka Bill, Ethics, Hawaii History

Contrary to popular opinion, Indian reservations have a history in Hawaii. An Oct. 12, 1999, article in the Honolulu Star-Bulletin describes the efforts of Kamehameha Schools/Bishop Estate (KSBE) trustees in 1995 to evade oversight of their corrupt doings. The Trustees’ self-serving investments caused losses of $264,090,257 in 1994 alone. To avoid scrutiny, they considered moving KSBE corporate headquarters out of Hawaii to the windswept plains of the Cheyenne River Sioux Indian reservation in South Dakota.

In the 1998 legislative session, Mr. Case proposed the 123-page ‘Native Hawaiian Autonomy Act.’ The Act would have terminated OHA and the Hawaiian Home Lands program, denied Native Hawaiians the right to self-determination and federal recognition, and reduced State liabilities to Native Hawaiians. The Act stated that its purpose is to stop the ‘continued dependence by native Hawaiians on others which prevents the development of the full potential of the native Hawaiian people.’”

Aiona: Volunteers raise $400,000 for Hawaii Fire Department
By Lt Gov Duke Aiona @ 2:16 PM :: 5386 Views :: Hawaii County , Akaka Bill, Energy, Environment

Dr. Frank Sayre and Laura Mallery-Sayre experienced first-hand the heroism of the Hawai‘i Fire Department when they lost their son in a hiking accident in Polulu Valley.  The Hawai‘i Fire Department did not have rappelling ropes long enough to reach the bottom of the valley, so firefighters flew a helicopter into the narrow terrain at great personal risk.

Since then, Frank and Laura, motivated by the bravery and heroism of the firefighters, began the Daniel Sayre Foundation to raise money to buy equipment for the Hawai‘i Fire Department. Their efforts have been met with resounding success in the community, as they have raised more than $400,000 to provide essential life-saving equipment and training for our firefighters.
