Gays Threaten Expulsion of 11 Democrat Legislators

News Release from GLBT Caucus of Hawaii Democratic Party

The Gay, Lesbian, Bisexual and Transgender Caucus of the Democratic Party of Hawai‘i (GLBT Caucus) has filed charges with Chair Tony Gill of the Oahu County Committee of the Democratic Party of Hawai‘i against Senators Mike Gabbard, and Donna Mecardo Kim [sic], Representatives Sharon Har, Henry J.C. Aquino, Karen Awana, Ty J.K. Cullen, Ken Ito, John M. Mizuno, Calvin K.Y. Say, and K. Mark Takai. The GLBT Caucus also filed charges against Representative Clift Tsuji with Chair Steve Pavao of the Hawai‘i County Committee of the Democratic Party of Hawai‘i.

The charges against all the legislators listed stem from them allegedly working against the platform of the Democratic Party of Hawai‘i, which is banned by Section 8A (c) of the Democratic Party of Hawai‘i Bylaws, that reads as follows:

Failure to abide by the Constitution of the Democratic Party of Hawai‘i and/or platform of the Party.

The listed legislators allegedly worked against the Democratic Party of Hawaii’s Platform specifically the Human and Civil Rights’ plank when they either authored or cosponsored Senate Bill 1292 or House Bill 1020.  These companion bills call for a Constitutional Amendment defining marriage as between one man and one woman. The specific section of the Democratic Party of Hawaii’s Platform is cited here:

We support the rights of the Lesbian, Gay, Bisexual, Transgender and Intersex community to equality before the law, including the right to equal relationship recognition including but not limited to equal marriage rights both at the State and Federal level. …

The charges first have to pass their respective county committees and if they are successful the legislators can appeal the decisions to the State Central Committee. If upheld the sentencing that is available to the committees range from censure to reprimand to expulsion from the Democratic Party of Hawai‘i.

SA: Kim (D, Kalihi Valley-Moana­lua-Halawa), a Catholic, (Notice how the atheist Advertiser has to include this religious identifier?) said she personally believes marriage should be between a man and a woman. But she said that lawmakers sponsor bills for a variety of reasons, so there are opportunities for full debates at the Legislature.

"It is a democracy, and everyone has the right to propose legislation," Kim said. "Whether that legislation goes through the process and manages to come out — that is to be determined by the majority. And especially in the case of a constitutional amendment — that's the right of the voters to vote."

Mizuno (D, Kamehameha Heights-Kalihi Valley), a Christian, also believes marriage should be between a man and a woman. He actually introduced two constitutional amendments — one that reserves marriage to heterosexual couples; one that would legalize gay marriage — so voters could decide.

Many gay activists consider marriage a civil right that should not be subject to the will of voters. Mizuno said he respectfully disagrees.

"It's the will of the people. Truly you can't get any closer to that than by allowing all of our voters the ability to shape policy," he said.
