Moving forward together — tentative settlement reached

Statement from KSBE, February 16, 2018

Aloha mai kākou,

A tentative settlement between Kamehameha Schools and the survivors of Dr. Browne’s abuse has been reached, which will soon bring closure to these legal proceedings. Our Trustees met yesterday to approve the mediators’ recommendation, and the majority of survivors have approved the settlement, as well.

The settlement includes a cash contribution as well as a commitment to establish a survivors’ fund.

The cash payment to plaintiffs totals $80 million, $65 million of which will be paid in 2018 and the balance of which will be paid over the next two years.

Kamehameha Schools has also established a special fund called Ho‘opakele, jointly named with the survivors, which will provide medical, counseling and psychiatric services for current, former or future students who have themselves experienced physical or sexual abuse while at Kamehameha Schools.

Ho‘opakele is administered through Mālama Ola, our centralized student safety center, and we will share more about this new initiative in the coming weeks.

Saint Francis Medical Center, the third party in the case, has chosen to ignore their responsibility as Dr. Browne’s employer during the 25 years of abuse, and they have not contributed to the settlement. We felt it was inappropriate to put our beneficiaries through any longer a process while we continued negotiating with Saint Francis’ board, so we chose to put forward Saint Francis’ portion now with full intention of pursuing our cross-claim against them and their insurers. The survivors and their attorneys have pledged their cooperation in our cross-claim against Saint Francis so that we may recover financially the portion of the settlement Kamehameha paid that is in fact Saint Francis’ responsibility.

Our kuleana as leaders at Kamehameha is to balance the needs and best interests of past, present and future generations. We invested great care and attention in our decisions so that our keiki and ‘ohana were considered in everything we did. We extend our deepest appreciation to all of you for voicing helpful perspective at community meetings, through phone calls, conversations and emails — heartfelt contributions which informed our resolution to do what is pono for all involved.

While our journey over the last few years has been a long and difficult one, we are a much stronger organization because of it. We will continue to fulfill our Princess’ promise to her people and serve our Lāhui for generations to come.

Summary

Three years ago we made a commitment to the survivors for a process that would be as painless as possible, recognizing they had already endured so much. Our settlement terms took into consideration the needs of survivors, the impacts on our organization and its mission, and the recommendation of mediators who have overseen thousands of cases. Most importantly, it has been about bringing closure to the pending litigation so that we may move forward and begin healing together.

Financial settlement

The tentative settlement, subject to probate court approval, includes a payment of $80 million to the survivors. We are prepared to pursue and collect additional funds from St. Francis Medical Center and its insurers. This settlement will result in the release of the survivors’ claims against Kamehameha Schools.

The Ho‘opakele survivor fund

As part of the settlement, a special fund will be established that provides medical, psychiatric care and counseling for students who have themselves experienced physical or sexual abuse while at Kamehameha Schools.

Serving our beneficiaries

Though the settlement will have an impact on our educational spend, we are confident that we can manage the financial impact of this settlement without compromising the success of our strategic plan. The best minds in student well-being have joined our Advisory Committee to help us enhance policies and procedures that optimize our learning environment incorporating the spiritual, cultural and clinical components of care. Our Mālama Ola center is furthering our culture of awareness and vigilance through trainings with faculty, staff and students. And in the area of advancement, our organization is engaging leaders throughout Hawaiʻi and across the globe in Vision 2040 to propel our state forward and deepen the collective impact of restoring our people through education. We have important work to do.

Sister Davilyn Ah Chick, chair of the St. Francis Healthcare System board of directors, released the following statement in response:

“The health and well-being of the men who were abused have been in our prayers. We were glad to learn from the media that Kamehameha Schools reached a settlement with their former students, so that these men can continue to move forward. We also would like to continue to move forward; however, we are disappointed to learn Kamehameha Schools will now be pursuing a claim against the Sisters of St. Francis, who for 135 years have been serving the people of Hawaii, St. Francis Healthcare System and our healthcare ministries.

“Many in the community count on St. Francis Healthcare System for hospice care, special care in their homes, adult day care and preschool, homeless outreach in Waianae, and other services. The claim may impact the people we serve as well as our strategic plans for our St. Francis Kūpuna Village in Liliha to meet the growing needs of seniors and family caregivers.”
