Lawsuit: Land Use and Environmental Regs Designed to Push ‘Minorities’ Out

IM: …The Two Hundred filed a lawsuit against the California Air Resources Board (CARB) on April 27, 2018, asserting that the Board is in violation of the California Environmental Quality Act (CEQA), the law that established the California Environmental Impact Statement (EIS) process.

"California’s commitment to climate leadership does not require or allow CARB to violate the civil rights of California’s minority communities, or constitutional and statutory mandates for clean air, fair housing, historic preservation, consumer protection, transportation mobility, CEQA, or administrative rulemaking."

The lawsuit asserts that California is the second most expensive state in the nation after Hawaii, has the highest poverty rate in the country—over 8 million people, and has the highest homeless population including about 25% of the nation’s homeless.

CARB relied on statewide economic data that masks regional differences. The basic costs—electricity and transportation—are highest in areas where minorities live, the inland areas that are hotter than the temperate coast and have longer commutes.

The San Francisco-Berkeley-Silicon Valley Bay Area has unprecedented technology-driven wealth that has driven up local housing costs, forcing African American and Latino populations to move eastward, thus causing re-segregation….

Gay Sex and blackmail inside the Halawa Correctional Facility

KITV: …A prison guard is dead after talking about his alleged "sex scandal" with an inmate and a few hours after that video went online, he was found dead.

In that video, the man confesses to what he calls "fraternizing" with an inmate.

"Now that this is out and everybody knows, I can't look at people the same, people can't accept the sexuality situation, some can some cant but I cant live with it, that's why I hid it for 30 years," Larry Peppers, former Halawa Correctional Facility ACO, said.

A chilling message from Larry Peppers. The former adult corrections officer committed suicide last Friday near the Makua cave on Oahu's Leeward coast.In the video, the Waianae resident admits to being bisexual and claims some inmates knew it. One in particular used that knowledge to seduce and get money from him.

Peppers claims inmate Benjamin Pada tricked him and talked Peppers into giving him a pair of his underwear covered in Peppers' semen.

Pada then allegedly used those fluids to claim Peppers raped him….

St. Francis Medical Center Tries To Stop $80M Settlement For Abuse Victims

CB: …St. Francis Medical Center is mounting a legal challenge to stop Kamehameha Schools’ landmark $80 million settlement with 32 former students who suffered sexual abuse during their time at the school.

The court appeal, which St. Francis announced in a statement Friday, could upend the effort to bring some closure to an ordeal involving one of Hawaii’s most powerful institutions, according to attorneys for the sex-abuse victims.

The Kamehameha Schools settlement was reached in February and is believed to be the largest of its kind in Hawaii. Notably absent from it, however, was St. Francis.

The facility employed homosexual child molester Dr. Robert McCormick Browne, a well-known liberal activist and ACLU board member, as its chief of psychiatry from the late 1950s to the mid 1980s, a period in which he saw hundreds of students at Kamehameha and is believed to have sexually abused at least 34 boys….

Soft on Crime: Child Molester Gets Probation

KITV: …A man who sexually assaulted a girl under the age of 14 was sentenced to probation Friday.

In a deal, Albert Mejia pleaded guilty to two counts of sex assault in the second degree, two counts of sex assault in the third degree, and one count of attempted sex assault in the third degree.

The girl informed her counselor of the assaults in August 2014. She said he was a family member's boyfriend, and it happened over the course of several years, according to police….

Soft on Crime: Lunatic OK for Release After Killing two

MN: … A woman acquitted of murder by reason of insanity in a vehicle crash in Upcountry in 2016 “presents a relatively low probability of danger”if she is released into the community under recommended conditions, a forensic psychologist testified Friday.

State psychologist Alex Lichton said Ashley Wellman was “very stable without significant signs of post-traumatic stress disorder” when he met with her Sept. 4 to evaluate her dangerousness.

He said she had been suffering acute symptoms of PTSD, re-experiencing a trauma and acting as if it were reoccurring on Oct. 8, 2016, when she ran a red light while traveling at least 127 mph uphill on Haleakala Highway to cause a crash that killed two people….

Second East Hawaii Homeless Shelter almost ready for families displaced by lava to move in

HTH: Hale Iki Village, a development of 11 micro-units built on property owned by Connect Point Church in Hawaiian Paradise Park, is slated to be finished this month….

Connect Point Pastor Dion Maeda, who is helping lead the response efforts of the faith community, said 10 families have been identified for Hale Iki, and a tentative move-in date of Sept. 18 is set. A grand opening is planned for Sept. 29.

Hope Services Hawaii “will be there to help us do the management of those who come in,” he said….

While Hale Ike will focus on family housing, a development of 20 micro-units at Sacred Heart Catholic Church in Pahoa, geared toward evacuees older than 60, was completed earlier this summer.

First residents moved in July 3, said Hope Services CEO Brandee Menino….

Initial residents came to the Sacred Heart shelter from the Pahoa Senior Center, Menino said. A second group of residents came from the emergency shelter in Keaau when that closed last month, and in between they took calls from others.

According to Menino, the last few units at Sacred Heart have been held for the closing of the Pahoa emergency shelter, which happens Monday.

Last week, Menino said three seniors who expressed interest in the Sacred Heart development were identified.

One moved in Thursday, another moved in Friday and the third will move in Monday.

Next week, Menino said they’ll be at capacity, but population counts are fluid, with people moving in and out. For instance, three residents already moved out into more permanent housing situations, she said.

Menino said the Hale Iki and Sacred Heart projects are the only two she is aware of that have been completed or are under construction. Other projects she has heard about are still in planning phases, she said….

The number of pedestrians killed in Hawaii this year is 6 times the figure in 2017

HNN: …Twenty-five pedestrians have died on Hawaii roadways so far this year….

The big increase in pedestrian deaths comes as motor vehicle deaths have declined this year.

As of Sept. 13, some 31 people have died in cars on Hawaii roads. That's compared to 45 at the same time last year.

The total number of traffic fatalities, which also include moped and bicycle deaths, is 79 so far this year.

At the same time last year, it was 72. …

Sen. Sullivan talks with Kavanaugh, says Supreme Court nominee recognizes unique Alaska Native rights

ADN: Sen. Dan Sullivan, responding to criticism that Supreme Court nominee Brett Kavanaugh could threaten unique laws and programs for Alaska Natives, said the judge told him directly this week that the legal rights of Alaska Natives are well-established by Congress and the courts.

"And he also said the trust responsibility for Alaska Natives is 100 percent clear from the Congress," Sullivan said, referring to the federal government's unique relationship with tribes, including in Alaska, that's important for protecting tribal rights and assets.

Meeting with reporters in Anchorage on Friday, on a weekend trip home from Washington, D.C., the Republican senator from Alaska said the half-hour-long phone call with Kavanaugh came in response to concerns raised by Alaska Native leaders and groups, including a statement from the Alaska Federation of Natives on Wednesday urging senators to vote against Kavanaugh's appointment….

"Native Alaskans are Indian tribes and therefore enjoy all of the relevant rights and benefits that come with their trust relationship with the United States," Kavanaugh replied to Hirono….
