Hawaii to appeal opinion on open-carry firearms
SA: The state appears to be getting ready to appeal last month’s 9th U.S. Circuit Court of Appeals opinion striking down the portion of Hawaii’s firearm licensing law that effectively prohibits carrying a firearm in public.
State Attorney General spokesman James Walther said no decision has been made as to what action, if any, the state will take in the wake of the July 24 opinion.
The state, however, had asked for an extension to file a petition for a rehearing and a petition for a rehearing by a larger panel of judges than the one that handed down last month’s opinion. The appeals court granted the request Thursday. The state now has until Sept. 14 to file its petitions….

No Democratic Party Poll Watchers For Primary
CB: The party’s state chair says it’s too late to train volunteers to keep an eye on poll workers in Saturday’s election….
Some Hawaii Democrats are upset that their state party has decided not to send poll watchers to observe precinct activities Saturday in the midst of contentious primary races.
State law allows parties to nominate poll watchers to see whether precinct workers are doing everything by the book. Poll watchers also have access to the list of who has voted, which allows them to notify other campaign workers if supporters of their candidate have not voted so they can be reminded to do so….

Hawaii’s New Police Shootings Review Board Finally Has Its First Case
CB: …Renie Cablay’s family knew what Honolulu police officers were up against this summer when they confronted the 55-year-old waving a large knife at them in the courtyard of his Waipahu condo complex.
For years, the 55-year-old fought depression and paranoia. There was a troubled second marriage and co-worker disputes at the Hawaii Department of Public Safety where he held a job as a correctional officer, according to his son, Kevin Cablay.
Before he resigned from his job last year, Cablay threatened a neighbor with a machete, leading to a six-hour standoff that ended with his arrest last October. “I don’t think he got the help he really needed,” Kevin Cablay said.
Eight months later, Honolulu Police Department officers were called to a motor vehicle accident near the man’s home, where they found Cablay waving a small knife at them. Cablay refused officers’ demands to put the knife down and ran to his second-story apartment. In that tight space, Cablay reportedly lunged at officers and he was shot and killed.
Now, Cablay’s shooting death will be the first case taken up by the state’s new Law Enforcement Officer Independent Review Board….

Habitual Criminal Finally Gets a Felony Conviction
MN: … After being arrested March 3 for shoplifting more than $100 of whiskey and wine from Kihei Safeway, Dewitt was charged with habitual property crime based on his criminal record that includes three petty misdemeanor convictions within the past 10 years.
“There’s a lot of people like Shonn who are committing small-time property offenses, nothing near the felony level,” said Deputy Public Defender Zach Raidmae.
But with the habitual property crime offense, “these people are getting arrested for what they normally do” and facing a felony charge, Raidmae said.
“Does he normally steal and trespass?” 2nd Circuit Judge Loo asked.
“Yes,” Raidmae said. “They’re all being put on notice that there’s this habitual property crime.”
After spending about five months in jail, Dewitt was “in a place where he’s ready to stop this nonsense” that includes convictions in multiple states, Raidmae said….

Homeless Mayhem in Kailua
SA: …Just last week there have been three incidents of concern that I know about. A man was urinating directly onto the wall of our building. A man was sleeping in the city parking lot on the sidewalk by our building, taking up the walk so no one could pass. I called the police and they came. The next day I discovered someone had defecated on the side of our building — major health issues.
This is in addition to the man who stands in the middle of the street waving his arms and yelling, and the woman who is often almost naked walking around Kailua. There are several others who really need help.
As a kupuna trying to “age in place,” I am greatly concerned, for not only my own safety and health but for others who live here. We need help.

Anti-Aquarium Nuts Wipe out 80% of Business
SA: The number of Hawaii reef fish caught by fishermen with commercial marine licenses has plummeted 80 percent since an October court order slowed the industry; meanwhile, the future of reef fish collecting for aquariums is likely to be determined by a review process that begins Wednesday.
The stakes are high for Coral Fish Hawaii in Aiea, a small business devoted to live fresh- and saltwater fish and aquariums. Sales are down at least 50 percent, and many of the store’s tanks have been empty or sparsely stocked since the court ruling banned the use of fine mesh nets, the preferred tool of reef fish collectors.
“It’s crushing,” said Coral Fish Hawaii owner Randy Fernley, who, at age 66, continues to scuba-dive once a week for reef fish. “It’s a lot more difficult to catch the fish. We’re literally a mom-and-pop store: my wife, Elise, and five part-time employees. I’ve been in business for 40 years, and I’ve got a mortgage to pay, car payments and a kid in school.
“There’s no problem with the resource, and there’s very few people doing it,” Fernley said. “There hasn’t been a lot of fish collected on this island, in contrast to what the activists say.”
At its 2017 peak number, the state Department of Land and Natural Resources’ Division of Aquatic Resources said in June that 38 fishermen with commercial marine licenses reported catching reef fish.….
