Another Deadline at the Capitol

On April 13 this week, a couple of deadlines have passed:
1. Deadline for bills to pass third reading in their non-originating chamber and to “cross back” to the originating chamber.
2. The deadline for the originating chamber to disagree with changes made to its bills by the other chamber. When the Senate and House disagree on a bill, members from each chamber can meet in conference committees to reconcile their differences.
That means that for bills still alive, if there is disagreement between the House and Senate on the bill, a conference committee will be set up with members from each chamber. Please note that only legislators who voted "yes" or "yes with reservations" can be appointed to a conference committee.
Upcoming Legislative Deadlines
APR 17 – SECOND LATERAL FOR SENATE CONCURRENT RESOLUTIONS – All Senate concurrent resolutions (SCRs) with multiple referrals must move to their final committee in the non-originating chamber (the House) by this day. (Must be filed by Friday, April 14.)
APR 21 – DEADLINE FOR FINAL FORM OF BILLS PROPOSING CONSTITUTIONAL AMENDMENTS – A proposed amendment’s final form must be provided by written notice to the Governor prior to passing final reading by a 2/3 vote in each chamber. Once adopted by the Legislature, the proposed amendment is submitted to the voters, in the form of a ‘yes or no’ question on the ballot, for ultimate decision.
APR 24– SECOND CROSSOVER FOR CONCURRENT RESOLUTIONS – Deadline for adopting amended concurrent resolutions in the non-originating chamber in order to “cross back” to the originating chamber. (Measures must be filed by Friday, April 21.)
APR 27 – FINAL DECKING OF NON-FISCAL BILLS – Deadline for submitting non-fiscal bills for final reading by both chambers.
Abortion pill ruling ping-pong action
Late Wednesday night, a three-judge panel at the U.S. Fifth Circuit Court of Appeals ruled that mifepristone, one of the drugs used in chemical abortions, will remain available while litigation regarding its initial approval by the FDA continues. However, the court reinstated important safety precautions that had been stripped away. This means chemical abortion drugs:
• can no longer be ordered through the mail
• can't be prescribed via telemedicine
• are limited to the first 7 weeks of pregnancy.
Meanwhile, the Biden Administration, in an emergency application, has asked the justices to stay all of a Texas judge’s ruling that curtailed access to the commonly used abortion medication mifepristone.
Today, the Supreme Court temporarily blocked lower court orders that would have limited access to the abortion pill. The justices are weighing in on the emergency request to leave current FDA approvals in place. The temporary order expires at 11:59 p.m. Wednesday.
History
The original lawsuit filed by Alliance Defending Freedom notes that the FDA never studied the safety of the drugs under the labeled conditions of use, ignored the potential impacts of the hormone-blocking regimen on the developing bodies of adolescent girls, and disregarded the substantial evidence that chemical abortion drugs cause more complications than surgical abortions.

In November 2022, Alliance Defending Freedom filed suit against the U.S. Food and Drug Administration (FDA) on behalf of four pro-life medical groups arguing that the abortion drug, Mifepristone, should not have been approved by the FDA and should be removed from the market.
• The suit claims that the FDA “failed America’s women and girls when it chose politics over science and approved chemical abortion drugs for use in the United States.
• And it has continued to fail them by repeatedly removing even the most basic precautionary requirements associated with their use.”
