Full Text: Eric Gill Sued by Local 5 Dissidents

Lawsuit Filed by Unite Here Local 5 President Hernando Tan, May 19, 2016

1. Plaintiff Hernando R. Tan (“Tan”) is a member in good standing and a duty elected officer of Unite Here Local Union 5 (“Local 5”). While serving in his capacity as President of Local 5 Plaintiff was suspended from his office without due process under Title I of the Labor Management Reporting and Disclosure Act nor compliance to provisions in the Unite Here Constitution and Local 5 Bylaws under Section 301 of the Labor Management Relations Act.

2. Said suspension was in retaliation and with unlawful intent arising from Tan’s criticism of Defendant Eric W. Gill (“Gill”) and Gill’s leadership of Local 5 and Tan’s announced plans to run against Gill for Financial Secretary-Treasurer of Unite Here Local 5 in the June 2016 internal union election.

The Member to Member Movement (MTMM) was formed by Local 5 members and interested community leaders who are actively working to see major CHANGE in our union and in our communities. MTMM is a duly registered non-profit organization under the laws of the State of Hawaii.

Facing some of the most challenging circumstances in the history of Local 5, the MTMM advocates for our workers’ unity & solidarity and encourages us all to act as watchdogs for financial accountability. We are actively supporting the election of Local 5 officers who will promote better union governance — especially the transparent accounting of how our union dues are being spent.

MTMM also believes that in order to more effectively advocate for the best interests and general welfare of our Local 5 workers, it is essential to utilize our social, economic and political standing within our wider communities. We believe by pulling together — union & non-union workers — we can improve the living and working conditions of all of Hawaii’s working people.
